MEMO TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />RE: <br /> <br />Dave Hartley, City Administrator <br /> <br />Merland Otto <br /> <br />April 22, 1988 <br /> <br />Airport Zoning <br /> <br />File: RA10:ll-5 <br /> <br />Per your request, I have outlined herein possible options which the <br />Council may wish to consider related to airport zoning. I mentioned I <br />spoke with Jack Ippel who will be requesting a joint City Council/Air- <br />port Commission meeting to discuss possible options. <br /> <br />As you recall, the primary purposes of adopting the airport zoning <br />ordinance were: <br /> <br />1) <br /> <br />To protect the airport's environment from development <br />encroachment during the period of study prior to establishing <br />control or ownership. (We ha~ previously discussed the <br />merits of a moratorium vs zoning.) <br /> <br />2) <br /> <br />Preventing establishment of-airport hazards in the approaches <br />or immediate vicinity of the airport. <br /> <br />3) Comply with state requirements for cost sharing eligibility· <br /> <br />At a minimum, the city should take the following actions: <br /> <br />1) <br /> <br />Submit documentation of proceedings to Mn/DOT regarding <br />election and effect on the Ordinance. This should occur <br />after any questions or concerns are resolved. <br /> <br />2) <br /> <br />Inform landowners in Zone A that City is reviewing options, <br />and will inform them of any change in status ~f it occurrs. <br /> <br />Specific options that may be considered follow. Obviously, some are <br />more politically sensitive than others. Also some may work against the <br />City from a timing standpoint vis-a-vis landfill decisions. <br /> <br />Make a determination as to what the results of the referendum <br />election actually require. Section 5.07 does not prohibit <br />the Ordinance from going into effect. The Council may elect <br />to simply set a date when the Ordinance would become <br />effective after certification of election results. <br /> <br />Determine whether there may be a conflict between the City <br />Charter provisions on referendum and Chapter 360.063 <br />Subds. 1 and 2 as well as 360.064, Subd. 1 providing the City <br />with the right to zone for airport hazards. <br /> <br />Make appropriate revisions to the Ordinance and follow <br />through adoption process again. This would have to be <br /> <br /> <br />
