MEMO TO:

FROM:

DATE:

RE:

Dave Hartley, City Administrator

Merland Otto

April 22, 1988

Airport Zoning

File: RA10:ll-5

Per your request, I have outlined herein possible options which the
Council may wish to consider related to airport zoning. I mentioned I
spoke with Jack Ippel who will be requesting a joint City Council/Air-
port Commission meeting to discuss possible options.

As you recall, the primary purposes of adopting the airport zoning
ordinance were:

1)

To protect the airport's environment from development
encroachment during the period of study prior to establishing
control or ownership. (We ha~ previously discussed the
merits of a moratorium vs zoning.)

2)

Preventing establishment of-airport hazards in the approaches
or immediate vicinity of the airport.

3) Comply with state requirements for cost sharing eligibility·

At a minimum, the city should take the following actions:

1)

Submit documentation of proceedings to Mn/DOT regarding
election and effect on the Ordinance. This should occur
after any questions or concerns are resolved.

2)

Inform landowners in Zone A that City is reviewing options,
and will inform them of any change in status ~f it occurrs.

Specific options that may be considered follow. Obviously, some are
more politically sensitive than others. Also some may work against the
City from a timing standpoint vis-a-vis landfill decisions.

Make a determination as to what the results of the referendum
election actually require. Section 5.07 does not prohibit
the Ordinance from going into effect. The Council may elect
to simply set a date when the Ordinance would become
effective after certification of election results.

Determine whether there may be a conflict between the City
Charter provisions on referendum and Chapter 360.063
Subds. 1 and 2 as well as 360.064, Subd. 1 providing the City
with the right to zone for airport hazards.

Make appropriate revisions to the Ordinance and follow
through adoption process again. This would have to be
