In April 1988, a <br />special election was held in the city, at <br />which time the following question was <br />presented to the electorate: <br /> <br /> Shall the Ramsey City Council, <br />acting as the Airport Zoning Board <br />of the City of Ramsey, adopt an <br />Airport Zoning Ordinance, which <br />Ordinance is intended to prevent the <br />creation or establishment of airport <br />hazards by regulating the location, <br />size, and use of buildings and <br />density of population under approach <br />zones and impose height restrictions <br />and hazardous use restrictions <br />within 1-1/2 miles of the Gateway <br />North. Industrial Airport? <br /> <br /> A majority of those persons voting at the <br />special election voted "No" on the above <br />question, and therefore, pursuant to the City <br />Charter, Ordinance 87-7 was not allowed to <br />take effect. <br /> <br />You then ask substantially the following questions: <br /> <br />QUESTION ONE <br /> <br /> Notwithstanding the City Charter <br />authorized referendum denying the adoption of <br />Ordinance 87-7, may the Ramsey City Council <br />under the authority of Minn. Stat. ~ 360.061 <br />(1988), et seq. and specifically Minn. Stat. <br />360.063, subd. 1 (1988), adopt zoning <br />regulations similar to those found in <br />Ordinance 87-7 in order to prevent the <br />creation or establishment of airport hazards <br />which could affect the use of Gateway North <br />Industrial Airport? <br /> <br /> <br />
