Councilmember Peterson quoted the present CUP Ordinance which states if an operation <br />closes for 12 months, that CUP becomes null and void. He stated some CUP's have been <br />left in effect when they should have become null and void. <br /> <br />Mr. Banwart, Community Development Director informed members present that the staff in <br />the Community Development Department have logged in all the CUP;s, organized and fred <br />them and then followed through with on-site inspections and contacted owners. The <br />responses have been good. There is usually a really need for CUP's. It's very delicate <br />trying to get good balance as to what is fair and also safeguards the City. <br /> <br />Commissioner Fults questioned if the CUP could be tied in with the building permit. <br /> <br />Mr. Banwart answered that we have to adopt the State's building code so it would be a <br />problem trying to tie the CUP to the building permit - we require a site plan. <br />Commissioner Fults asked about a CUP with regards to hazardous waste. <br /> <br />Mayor Reimann replied that hazardous waste is controlled by the County and the State and <br />CUP's. We have to uphold state laws but you the City laws can be more stringent than <br />state laws. <br /> <br />Case #3: Discuss communications <br /> <br />Chairman Wagner explained the intent of this case was to discuss a way in which the <br />Commissions and the City Council could exchange information. He stated the EDC wasn't <br />sure how to address that issue. He pointed out that the communication with City Staff had <br />improved, however, when recommendations are made to staff or City Council, there is no <br />feedback to let the Commission know if the recommendations were taken. He said the <br />Commission feels isolated at times and asked for some input on the subject. <br /> <br />Councilmember DeLuca suggested that the chairman or a representative from the <br />Commission attend the City Council meetings. It would benefit the Council to have the <br />direct input and it would benefit the Commission as far as they would know what's <br />happening with the recommendations <br /> <br />Chairman Zimmerman stated he had been to Council meetings before but that he wasn't <br />asked for any input. His feelings are that the Commissions are the recommending bodies <br />and the City Council makes the final decisions and the Commissions respect the Council's <br />decision. <br /> <br />Councilmember Peterson said the communication is better than in the past which is good. <br />He also felt that the Economic Development Commission bringing the issues to the City <br />Council and the Planning and Zoning Commission before going to the property owners <br />with their proposal was a good plan. <br /> <br />Councilmember Pearson feels this joint meeting is a step forward in closing the <br />communication gap. <br /> <br />Mayor Reimann suggested a copy of the Council minutes and specific issues should be sent <br />to the Commissions involved. <br /> <br />Commissioner Fults asked if the Council knows what the Commissions are trying to do. <br />He said the Councilmembers should tell the Commissions how they feel and <br />communications will be better. <br /> <br />CITY COUNCIL/EDC/P&Z MINUTES <br /> Page6 of 8 <br /> <br /> <br />
