Motion by Commissioner Shumway and seconded by Commissioner Terry to table discussion of street light requirements until the regular Commission meeting in March. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Shumway, Terry, Holm, Hendriksen and LaDue. Voting No: None. Absent: Commissioner Howell. Case #5: Request For A Conditional Use Permit To Maintain A Horse Hobby Farm; Case Of Rhonda Williams and Philip Swiggum: Commissioner Shumway recalled that this case was tabled in January pending the receipt of a report from the Minnesota Horse Council. Apparently, the Minnesota Horse Council is involved in the licensing of commercial stabling businesses and will not become involved in private disputes regarding the housing of horses. Motion by Commissioner Shumway and seconded by Commissioner Terry directing that Case #6 address the possibility of resurrecting the proposed amendment to the Keeping of Horses ordinance that was recommended for adoption by P&Z and denied by City Council in 1988. 1988. In the interim, Ms. Rhonda Williams' request for a conditional use permit is tabled. Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, Holm, Shumway and Terry. Voting No: None. Absent: Commissioner Howell. Ms. Rhonda Williams was present and stated that the Community Development Technician's map of his analysis of her petition is in error and she submitted a corrected version. Ms. Williams also noted that the analysis indicates that her petition was biased and she disagrees with that statement as some of her direct neighbors are not opposed to her request and are not horse owners. Ms. Williams also submitted various other items of information. Commissioner Shumway directed that the additional information submitted by Ms. Williams be included in the March agenda packet. Case #6: Review Of Draft Horse Ordinance: Commissioner Shumway suggested that he meet with City Council to do an in-depth review of the proposed amendment to the Keeping of Horses ordinance denied by them in 1988. Commissioner Holm stated that the current ordinance requires 3 acres per horse; the proposed ordinance amendment of 1988 would permit the keeping of horses on 2.5 acre lots; he believes 2.5 acre subdivisions were intended to be strictly residential development and not horse hobby farms; requiring a minimum of 3 acres for at least the first horse is a good policy. Commissioner Hendriksen noted, and the Commission agreed, that the proposed ordinance provided in the agenda packet is not the version that was proposed for adoption in 1988. Section 110.073, Item #3 should read as follows: 'No person shall leave accumulations of horse manure on any paved portion of a street, sidewalk or alley.'
