Item #33 should indicate that the use will not impair the market value of <br />surrounding property. <br /> <br />Item #34 should indicate that the use will not impair the market value of <br />surrounding property. <br /> <br />Item #35 should indicate that the use will be harmonious with the Comprehensive <br />Plan. <br /> <br />Item #36 should indicate that the use will be designed to be harmonious in <br />appearance and will not change the character of the area. <br /> <br />Item #37 should indicate that the use will not be hazardous to neighboring uses. <br /> <br />Item #38 should indicate that the use will be an improvement to the property. <br /> <br />Item #39 should indicate that the use will be adequately served by public facilities. <br /> <br />Item #40 should indicate that the proposed use will not create excessive additional <br />requirements for public facilities. <br /> <br />Item #41 should indicate that the proposed use will not involve uses that will be <br />detrimental to any persons or property. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Terry, Shumway and <br />LaDue. Voting No: None. Absent: Commissioners Holm and Hendriksen. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Shumway that the <br />Conclusion to the Findings of Fact indicate that the proposed use does comply with City <br />Code and that the Planning and Zoning Commission recommends approval of the request <br />for a conditional use permit. <br /> <br />Motion carried. Voting Yes: Chariman Zimmerman, Commissioners Terry, Shumway and <br />LaDue. Voting No: None. Absent: Commissioners Holm and Hendriksen. <br /> <br />The Commission proceeded to review the proposed conditional use permit. <br /> <br />Ms. Sharon Watson, attorney representing Mr. Daniel Karst, Jr., was present and stated <br />that she has been informed that the City Attorney is not opposed to reducing the vehicle <br />liability coverage to $250,000. Ms. Watson stated that another concern of Mr. Karst was <br />that of being allowed sufficient time to implement the improvements to the property; time <br />fi'ames can be addressed during the site plan process. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry to recommend that <br />City Council approve Mr. Daniel Karst, Jr.'s request for a conditional use permit, amended <br />as follows: <br /> <br />ao <br /> <br />Item 26.b.ii should be revised to require auto and truck liability coverage in <br />the amount of $250,000.00. <br /> <br />b.
