Mr. Banwart reiterated that the City cannot discriminate and make land use decisions based <br />on ownership of the land. <br /> <br />Sharon Dahlgren - Inquired if the residents affected by change have a voice in issues; if <br />they do, then they have not been heard. <br /> <br />Mr. Banwart stated that there were a number of parcels that requested being served by <br />sewer and water; the City had the capacity to serve them and requested a MUSA boundary <br />amendment to serve those parcels. In addition, the tax base from urban development is <br />substantially more than that received from 2.5 acre subdivisions. All these factors are <br />called the growth of a city. <br /> <br />Don Jazdzewski - Inquired again as to the basis for the Commission's decision to approve <br />Juniper Woods. <br /> <br />Commissioner Hendriksen stated that the decision is based on findings of fact which are <br />public record. Commissioner Hendriksen reiterated that he was present at the public <br />hearing for preliminary plat approval for Juniper Woods; the request was tabled; there were <br />negotiations between the developer and area residents; lot lines were redrawn; concerned <br />area residents did not show up at subsequent meetings; he did not receive any more phone <br />calls from concerned residents; he personally felt that the opposition had gone away. <br /> <br />John Lucia - 14341 Uranium Street N.W. - Inquired as to the basis for determining the <br />developers stated need to develop at urban size lots versus 2.5 acre lots is a fact. <br /> <br />Commissioner Hendriksen stated that the cost of extending sewer and water into the area, <br />whether it serves 1 lot or 100 lots, is the same. From an economic standpoint, the greater <br />number of lots there are, the greater the profit motivation. Commissioner Hendriksen <br />stated that he is pro consistent development and pro people's rights; a developer also has a <br />right to develop property, but harmoniously with the neighborhood. <br /> <br />Sue Damyanovich - Stated that Mr. Miller requested preliminary plat approval of Juniper <br />Woods. Mr. Miller stated that he had accommodated the concerns of surrounding residents <br />by revising the plat to one acre lots on the perimeter and smaller lots on the interior. At that <br />time, surrounding residents were also concerned with the city granting plat approval to an <br />urban development that was not in the 1990 Urban area and prior to Metro Council <br />approval of a MUSA boundary expansion. The citizens lost interest in following the case <br />because the municipal services issue had to be resolved first. <br /> <br />Don Jazdzewski - Requested clarification of the two year hook up requirement. <br /> <br />Mr. Banwart replied that properties directly abutting sewer and water lines would be <br />required to connect to the services within a two year time frame. Rum Acre Estates and <br />Gorham's Sandy Acres are not in the MUSA area and would not be able to connect to <br />services. <br /> <br />Terry Richert - 15231 Waco Street N.W. - Stated that he feels urban development adjacent <br />to his property will have a negative affect on his property value.
