Hendriksen indicated that the City is liable for it's attractive nuisances; the intersection of <br />Hwy. #10 and Ramsey Blvd. is already a high traffic area; the expansion will increase <br />traffic in the area; use of road right-of-ways for off-street parking needs to be mitigated. <br />Mr. Robert Wojcik stated that he is willing to provide off-street parking during off business <br />hours. <br /> <br />Motion failed. Voting Yes: None. Voting No: Chairman Zimmerman, Commissioners <br />Hendriksen, Deemer and Bawden. Absent: Commissioners Shumway, LaDue and Terry. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to amend <br />Item #21 of the proposed findings of fact to indicate that the proposed expansion will be <br />unduly dangerous to persons residing or working in the vicinity. <br /> <br />Motion carded. Absent: Commissioners Shumway, LaDue and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Chairman Zimmerman to amend Item <br />#22 of the proposed findings of fact to indicate that the proposed use will not substantially <br />impair the use or market value of surrounding property. <br /> <br />Further Discussion: Commissioner Deemer stated that the proposed expansion includes <br />site improvements that would be an improvement over vacant land. Commissioner <br />Hendriksen stated that whether or not the expansion is an improvement depends on <br />whether the inventory will consist of clean, quality, operable cars or if the operators will <br />again accumulate junk cars once the expansion request is through the process and approved. <br />Commissioner Hendriksen recalled that when the applicants were operating a used vehicle <br />sales lot on the east side of Cty. Rd. #56, junk cars accumulated; he feels this same <br />situation may happen again once the expansion is approved. Commissioner Deemer noted <br />that there was not a conditional use permit in effect when the applicants operated their <br />vehicle sales lot on the east side of Cty. Rd. #56; the site on the west side of Cty. Rd. #56 <br />is under a conditional use permit which gives the City more control. <br /> <br />Commissioner Deemer and Chairman Zimmerman withdrew their motion. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Bawden to amend <br />Item #22 of the proposed findings of fact to indicate that the proposed use will substantially <br />impair the use or market value of surrounding property. <br /> <br />Motion carded.
