Case #3: Request For Sketch Plan Review Of Gordon's Gardens 2nd
Addition; Case of Mr. Harley Gordon:

Mr. Banwart stated that in April, 1989, the proposed plat was submitted as a minor
subdivision consisting of 4 lots. Since that time, Harley Gordon has revised the plat to a
full subdivision consisting of 7 lots. Following tonight's review of the sketch plan, the
plat will return to the Commission for a preliminary plat public hearing.

The Commission proceeded to review the City Engineer's report dated August 29, 1989.

It was noted that efforts to negotiate with Kenneth R. and M.K. Lewandowski for the
purchase of land necessary to extend 180th Avenue N.W. up to Gordon's Gardens 2nd
Addition have been unsuccessful.

The consensus of the Commission was that the City should proceed with condemnation
action to acquire the land necessary to extend 180th to Gordon's Gardens 2nd Addition and
that Harley Gordon would be responsible for the cost of those condemnation proceedings.

Harley Gordon stated that he can plat his property with a cul-de-sac, provide an easement
for the future extension of 180th Avenue and develop 4 lots; he doubts that the creation of
two additional lots will be cost effective in comparison to the cost of condemnation and
constructing 180th as a through street.

Motion by Commissioner Shumway and seconded by Commissioner Deemer to approve
the sketch plan for Gordon's Gardens 2nd Addition contingent upon the plat being
modified to remove the cul-de-sac and indicate a through street, lots being reconfigured to
meet the 200 foot frontage requirement and the City proceeding with condemnation action
to acquire property necessary to extend 180th Avenue N.W. to the boundary of Gordon's
Gardens 2nd Addition.

Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Shumway,
Terry, Bawden, Hendriksen and LaDue. Voting No: None.

The Commission recessed at 8:55 p.m.

Chairman Zimmerman called the meeting back to order at 9:15 p.m.

Case #4:

Request For Preliminary Plat Approval Of Haubrich Addition;
Case Of John And Marilyn Haubrich:

Deleted from agenda due to lack of required information by applicant.

Case #5: Request For Preliminary Plat Approval Of North Forty 3rd
Addition; Case Of Richard J. Sybrant, R.J. Builders, Inc.:

Deleted from agenda due to lack of requirement information by applicant.

Planning & Zoning Commission/September 5, 1989
Page 5 of 8
