The Commission proceeded to review the proposed findings of fact. <br /> <br />The Commission noted Staff's concern regarding recreational vehicle sales not being the <br />highest use of property soon to have sewer and water available to it and possibly not being <br />compatible with development planned in this area for the future. The Commission felt that <br />placing a time frame on the conditional use permit to insure it's availability for development <br />with a higher use when sewer and water is available is not critical because if and when <br />there is a demand for sewered industrial property, economics will cause the owners to re- <br />evaluate the best use of the property. <br /> <br />Robert McElhaney stated that he would not be adverse to a 3 year time frame on the <br />conditional use permit. <br /> <br />Planning Assistant Frolik noted that G.O. Racing will continue to occupy the shop area of <br />the existing building, but from a public safety standpoint, she is concerned with a third use <br />at the property which involves some minor tractor/trailer activity. The Commission did not <br />share Ms. Frolik's concern. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner Deemer to recommend <br />that City Council adopt the proposed findings of fact relating to Robert McElhaney and <br />Mark Manthei's request for a conditional use permit to operate a recreational vehicle sales <br />lot in the I-1 Industrial District. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Bawden, Deemer and Shumway. Voting No: None. Absent: Commissioner Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to <br />recommend that City Council approve Robert McElhaney and Mark Manthei's request for a <br />conditional use permit to operate a recreational vehicle sales business in the I-1 Industrial <br />District for a 3 year period. <br /> <br />Further Discussion: Commissioner Hendriksen stated that he was of the understanding that <br />the City Attorney has indicated that State Statute does not allow establishing times frames <br />on conditional use permits. Mr. Otto stated that the City Attorney is not comfortable with <br />placing time frames on conditional use permits; however, the City has issued conditional <br />use permits for tire processing and vertical expansion of the landfill with time frames. <br />Commissioner Hendriksen stated that if it is the City's desire to see the recreational vehicle <br />sales lot terminate in a short period of time, the request should be approached from a <br />different perspective. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Deemer, Bawden and Shumway. Voting No: None.
