Chairman Zimmerman stated that he does not totally agree that some of the wetlands need <br />preserving as they are already protected by ordinances. <br /> <br />Commissioner Shumway stated that in the future, the Commission should review and <br />amend the PUD seciton of City Code for clarification purposes. <br /> <br />The Commission proceeded to review the proposed f'mdings of fact relating to the rezoning <br />of Trott Brook Ponds to PUD. <br /> <br />Jeff Caine of Caine and Associates was present representing Gerald Bauer and indicated <br />that the findings should be amended to indicate a total acreage of 208 and proposed lots at <br />83. <br /> <br />Commissioner Hendriksen expressed concern that allowing protected wetlands to satisfy <br />the PUD 20% public/private open space requirement is getting the City back into the <br />previous scenario of accepting swamps to satisfy park dedication requirements. <br /> <br />Commissioner Deemer stated that he believes the proposed road alignment in Trott Brook <br />could be made safer by eliminating the need to access the proposed 174th onto Hwy. #47. <br /> <br />Motion by Commissioner Bawden and seconded by Chairman Zimmerman to amend the <br />proposed findings of fact by eliminating Item g9 indicating that the City is interested in <br />acquiring wetlands on the property for storm water management purposes. <br /> <br />Further Discussion: Commissioner Hendriksen stated that whether or not the subject <br />wetlands are in the City's Comprehensive Plan for storm water management should be the <br />deciding factor as to whether or not the City wants to acquire the wetlands. Mark Banwart <br />provided the Commission with a copy of the Comprehensive Plan which indicated that the <br />area wetlands are desired for storm water management purposes. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendfiksen, LaDue, <br />Deemer, Bawden and Shumway. Voting No: Commissioner Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to add Item #13 <br />to the proposed findings of fact indicating that the street layout in the plat was rearranged to <br />protect wetlands on the site. <br /> <br />Motion carried. Voting Yes: Chakrnan Zimmerman, Commissioners Hendriksen, LaDue, <br />Deemer, Bawden, Shumway and Terry. Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Shumway to add Item <br />#14 to the proposed findings of fact indicating that the streets proposed in the plat could be <br />further rearranged to alleviate a safety problem along Hwy. #47. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Deemer, Bawden, Shumway and Terry.
