Case #3: Request For Final Plat Approval Of Oleo Acres Addition; Case <br /> Of Boyd R. Hanson: <br /> <br />Mark Banwart recalled that Council granted preliminary plat approval to Oleo Acres on <br />December 19, 1989. City Staff is recommending a variance to the requirement for soil <br />borings as the soils classification in the subject area is Class I; the Building Official still has <br />the authority to require a soil boring on questionable lots. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt <br />Resolution #90-01-22 granting final plat approval to Oleo Acres Addition contingent upon <br />compliance with the City Engineer's report dated January 23, 1990. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Case #4: Request For Final Plat Approval Of Tooth Acres Addition; <br /> Case Of James M. Martin: <br /> <br />Mark Banwart stated that since Council's tabling of the Tooth Acres preliminary plat on <br />December 19, 1989, the developer and the County have agreed upon the sale of the <br />southern portion of the property to the County. City Staff met with the developer and <br />County staff in an effort to facilitate the County's aim for land acquisition and the City's <br />aim to preserve a proposed corridor through the subject property for a future Mississippi <br />River bridge crossing. The City promoted platting the property into Outlots A, B, C, D, E, <br />F and G with Outlots B, D, E, F and G to be owned by the County; Outlots B and E <br />coinciding with the proposed Mississippi River Bridge corridor alignment. The Planning <br />and Zoning Commission met at 7:00 p.m. on January 23, 1990 and recommended <br />preliminary plat approval with some reservations that Outlots B and E would be designated <br />to also provide for a trail alignment that would evetually tie into the Hennepin County Trail <br />System. City Staff is recommending that park dedication requirements be waived in lieu of <br />the plat only creating outlots and facilitating a future Mississippi River bridge crossing. <br />Mark Banwart noted that the developer would retain ownership of Outlots A and C which <br />would not be buildable until they are resubdivided into lots. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt <br />Resolution #90-01-23 granting final plat approval to Tooth Acres Addition. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Case #5: Gateway North Industrial Airport: <br /> <br />Mr. Otto stated that the City has gone through various stages to draft an airport master plan <br />study, adopt the airport master plan and layout, obtain Mn/DOT and FAA approval of <br />airport master plan, achieve inclusion of Gateway North Industrial Airport into the National <br />Airport System Plan, complete an environmental assessment, and obtain Mn/DOT and FAA <br />approval of the environmental assessment. In addition, City Council adopted an airport <br />safety zoning ordinance in 1987; that ordinance was brought forward to a referendum, was <br />defeated and not placed into effect. This raised the question of whether or not the <br />community had authority to review and revoke land use zoning ordinances. To that end, <br />City Attorney Goodrich prepared questions for the Attorney General's office and sought an <br /> <br />City Council/January 23, 1990 <br /> Page 8 of 16 <br /> <br /> <br />
