Case #4: <br /> <br />Introduce Ordinance Establishing Controls On The <br />Construction, Operation, Inspection, Monitoring and <br />Maintenance Of Solid Waste Disposal Facilities: <br /> <br />Mr. Otto stated that because of a negative review by Metro Council and changes in MPCA <br />rules, the proposed ordinance previously presented to City Council has been revised. The <br />intent of the proposed ordinance is to establish local controls over new landfill solid waste <br />facilities in the City. Mr. Otto reviewed the major elements of the proposed ordinance with <br />City Council. Mr. Otto noted that the legislative commission on waste management met <br />and passed a draft bill which will extend to other government authorities and private entities <br />the power to override local zoning authorities. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cich to introduce <br />Ordinance #90-X amending Chapter 170.01 establishing controls on the construction, <br />operation, inspection, monitoring and maintenance of solid waste disposal facilities. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson and <br />Cich. Voting No: None. Abstain: CouncilmemberPeterson. <br /> <br />Mr. Otto stated that he has prepared a resolution for Council consideration which formally <br />establishes the City position with respect to use of buffer areas of future landfill sites. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt <br />Resolution//90-02-048 stating City's position with respect to candidate landfill site buffers. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson and <br />Cich. Voting No: None. Abstain: CouncilmemberPeterson. <br /> <br />Case #5: Appointment To Landfill Inventory Site Selection Authority: <br /> <br />Mr. Hartley was temporarily out of Council Chambers and City Council proceeded to Case <br />#7.
