Further Discussion: Councilmember Pearson inquired as to any controls for any materials
being hauled into the subject site. Mr. Banwart replied that this action is specific to grading
and mining on the size; there are other applicable ordinances dealing with dumping of
debris. Councilmember Peterson inquired as to the limit placed on exposed area. Mr.
Banwart replied that he believes exposed area is limited to 10 acres.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Cich and
Pearson. Voting No: CouncilmemberPeterson.

PRESENTATION BY SENATOR DAHL

Senator Dahl was present to review the items he will be working on as Chief Author in the
1990 Legislative session and to listen to Ramsey's concerns. Senator Dahl stated that his
primary goals for 1990 include providing equity in funding for north suburban schools, the
2+2 program at Anoka-Ramsey Community College, legislation regarding watershed
management, legislation to abolish the current inventory of landfill sites, legislation to
provide resources to reduce tree destruction caused by oak wilt.

Mayor Reimann stated that the City appreciates Senator Dahl's efforts to abolish landfill
siting but if that is not successful, there should be compensation made to the hosting
communities of landfills.

Councilmember Cich expressed concern with Metro Council's control over Ramsey and his
concern with the need to reduce government spending at the State level.

Senator Dahl suggested that the City contact Metro Council Board member Ken Kunzman
with concerns regarding Metro Council. Senator Dahl stated that there is no member of the
Senate more fiscally conservative than he.

Councilmember Cich expressed concern with the impact of increased property taxes on
fixed income persons.

Senator Dahl agreed that property tax is the most unfair tax because it has no correlation to
the ability to pay; and that he is committed to balancing the budget through budget cuts
versus the rainy day fund but he is only one of 67 senators.

Mr. Otto referred to recommendations from the Legislative Commission on Waste
Management that would allow private entities to exercise zoning controls with respect to
landfills. Mr. Otto requested that Senator Dahl sponsor Ramsey's proposed amendments
to establish local controls on solid waste disposal facilities.

Senator Dahl stated that he will be chairing the Environmental Subcommittee and will
delighted to cooperate with Ramsey.

Mr. Hartley stated that Ramsey is concerned that the Solid Waste Management Act of 1980
might have worked had the agencies responsible for protecting the environment done their
job. Three potential landfill sites have been selected in Anoka County that are not
environmentally suitable. Agencies charged with enforcing the laws Legislature put in
place are not doing so and are changing their own regulations to avoid enforcing those
laws. Mr. Hartley asked for Senator Dahl's assistance to cause those agencies to enforce
their own regulations and the State laws or establish statutory laws that are detailed enough
so that regulations will not be changed for the purpose of avoiding enforcement of laws.

City Council/February 13, 1990
