Edward Moersfelder, attorney for Waste Management of Minnesota, Inc., stated that a <br />similar process was gone through in 1985 when development limitations were lifted for the <br />south borrow area and it was determined at that time when City Council could take action. <br />It was determined that City Council could take no final action until development limitations <br />were lifted; there was no legal impediment to taking action contingent upon the decisions of <br />Metro Council and Anoka County. Waste Management is not asking the City to take final <br />action on the compost proposal before Metro Council and Anoka County have acted; Waste <br />Management is asking that concurrently with Metro Council and Anoka County reviews, <br />they be allowed to make a presentation to the City's Planning and Zoning Commission and <br />work with City Staff so that there will be a working document to bring before City Council <br />if the development limitations are lifted. Mr. Moersfelder suggested that the proposed <br />resolution be modified to indicate no final action by the City will be taken until Metro <br />Council and Anoka County have taken action. <br /> <br />Mr. Banwart stated that the City of Ramsey is a growing community with limited staff; to <br />allocate staff time to work on the proposal prior to knowing the decisions of Metro Council <br />and Anoka County is not appropriate. In addition, spending staff time on the effort at this <br />time would lay out a perception of City approval to Metro Council and Anoka County. <br /> <br />Mr. Goodrich stated that the law does allow the City to proceed on the request for a <br />conditional use permit but he concurs with Mr. Banwart in that the City would have a better <br />product if it did not take action until after Metro Council and Anoka County have taken <br />action. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cich to adopt <br />Resolution #90-02-056 requesting Metropolitan Council to approve/not approve Waste <br />Management of Minnesota, Inc.'s request to establish a yard waste compost site in the "Site <br />P" Landfill Site and Buffer Area. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson and <br />Cich. Voting No: None. Abstain: CouncilmemberPeterson. <br /> <br />Case #3: Consider Adopting Ordinance Abolishing Airport Commission: <br /> <br />Mr. Goodrich recalled that the ordinance to abolish the Airport Commission was introduced <br />on February 13 and is eligible for adoption at this time. <br /> <br />Councilmember Pearson stated it was his intent to stop spending money on the airport issue <br />but it was not his intent to abolish the Airport Commission or take away one of the <br />arguments for Site P not being selected. Councilmember Pearson then presented a <br />proposed resolution. <br /> <br />Mr. Goodrich read the proposed resolution out loud. The resolution called for a joint <br />meeting between City Council and the Airport Commission to redefine the duties and <br />purpose of the Commission; made appropriate Staff available to the Commission; <br />authorized closing out past projects and making application for reimbursement of funds; <br />authorized the Commission to explore possible means and/or agency interest in financing <br />the City's share for airport project implementation. <br /> <br />The Council discussed the proposed resolution. <br /> <br />City Council/February 26, 1990 <br /> Page 8 of 13 <br /> <br /> <br />
