In order to guarantee that a home occupation, once authorized, will not <br />become a nuisance to the neighbors or otherwise violate these guidelines, <br />the Planning Commission may recommend and the Council may impose, <br />reasonable conditions necessary to protect the public health, safety, and <br />welfare. <br /> <br /> Subd. 5. Inspections. There may be one annual inspection each year by the <br />Zoning Administrator of any property covered by a home occupation permit. In addition, the <br />Zoning Administrator and/or his/her designee, shall have the right at any time, upon reasonable <br />request, to enter and inspect the premises covered by said permit for safety and compliance <br />purposes. <br /> <br /> Subd. 6. Term of Home Occupation Permits. Home Occupation permits <br />granted by this Section shall be temporary in nature and shall be granted to a designated person <br />who either resides in the dwelling on the subject property; or in the absence of a dwelling, owns <br />the accessory structure on the subject property. Permits are not transferable from person to <br />person or from address to address, unless the transfer is in accordance with the provisions of <br />Subd. 7.a (General Provisions) of this sub-section. <br /> <br />Subd. 7. <br /> <br />General Provisions <br /> <br />ao <br /> <br />Should a Home Occupation Permit holder die or move to a new location, the <br />existing Permit shall be automatically terminated. Except that in the case of <br />death, should a surviving spouse or child, residing at the same address or <br />receiving title to the property containing the accessory structure with no <br />dwelling, desire to continue the home occupation, written notice to that <br />effect shall be given to the Zoning Administrator and the Council may <br />authorize continuation of that Permit without further hearing. <br /> <br />bo <br /> <br />Home Occupation Permits, once granted, may be revoked prior to its <br />original revocation date by the Council for cause after hearing before the <br />Council. Complaints seeking the revocation of such permit shall be filed <br />with the Zoning Administrator. All such revocation hearings, publication <br />and notice requirements shall be the same as for Conditional Use Permits in <br />accordance with Sub-section 9.03.05 of this Code.. <br /> <br />Co <br /> <br />All businesses being conducted at property zoned for residential use on the <br />effective date of this Section and for which a Home Occupation Permit is <br />determined to be required by this Section, shall have thirty (305 days <br />thereafter to apply for a Permit. <br /> <br />do <br /> <br />Persons who were conducting a business from property zoned for residential <br />use on the effective date of this Section, and said business use requires a <br />Home Occupation Permit, must make application in accordance with sub- <br />section 9.03.05, but may continue to conduct such businesses pending final <br />determination of their application.
