Mr. Brevig indicated that a car lot limited to 50 vehicles can be successful economically. <br />Mr. Brevig inquired if the site would remain limited to 50 vehicles if the property is zoned <br />B-1. <br /> <br />Mr. Goodrich replied that if the rezoning occurs, the site would not be limited to 50 <br />vehicles unless at the same time the City puts additional restrictions on B-1 zones or auto <br />lots. <br /> <br />A discussion ensued regarding the landscaping that was required in the conditional use <br />permit issued in 1988. Ms. Frolik indicated that without consuming great amounts of staff <br />time, she has been unable to determine if the landscaping requirements were ever fulfilled. <br /> <br />Upon request, Mr. Brevig provided City Attorney Goodrich with the statistics of his State <br />license (//20515, issued to Richard Brevig, Ramsey Sales, 7205 Hwy. #10 N.W.). <br /> <br />Douglas Fountain - 15255 Garnet Street N.W. - Inquired as to the status of encroachment <br />onto Cry. Rd. #56 right-of-way by Ramsey Auto Sales. <br /> <br />Ms. Frolik indicated that at the time the conditional use permit was issued, the County <br />requested 27 feet of additional right-of-way. The applicant for the conditional use permit, <br />Roger Hurd, could not fulfill that requirement because he was not fee title owner of the <br />property. Mr. Otto then discussed the matter with the County and they withdrew their <br />request for the additional fight-of-way indicating they would acquire it when it was needed. <br /> <br />Mr. Fountain inquired if the auto sales lot is encroaching on the exiting Cty. Rd. #56 right- <br />of-way. <br /> <br />Mr. Banwart indicated that the County has signed the right-of-way and it appears that the <br />operation is not encroaching onto the right-of-way. <br /> <br />Councilmember Peterson stated that he is still concerned with prospective buyers parking in <br />the right-of-way to look at autos for sale during off-business hours. <br /> <br />Mr. Brevig indicated that he blocks the sales lot in such a way during off-business hours <br />that there is still room for four vehicles to park on the site versus in the fight-of-way. <br /> <br />Mr. Banwart noted that upon the City's request, Mn/DOT will be posting 'no parking' <br />signs along Hwy. #10. <br /> <br />Upon inquiry, Mr. Brevig informed Mr. Goodrich that there is no type of business <br />partnership between himself and Mr. Wojcik. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember DeLuca to retain the <br />conditional use permit status at 7205 Hwy. #10 N.W. and to require that the leasee of the <br />property, Mr. Richard Brevig, enter into an agreement to have a valid State license at all <br />times, to abide by the terms of the conditional use permit issued in 1988, to provide the <br />City with a copy of the written lease on the property which indicates the relationship <br />between Robert Wojcik and Richard Brevig, and to provide the City with a copy of the <br />bond required for State licensing. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson and <br />Cich.
