Case #16: Request For Off-Sale Intoxicating Liquor License; Case Of <br /> ADH, Inc.: <br /> <br />Mr. Hartley noted that the Police Department's investigation of the applicant shows no <br />reason to disapprove the granting of an off-sale intoxicating liquor license to ADH, Inc. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Pearson to approve the <br />issuance of an off-sale intoxicating liquor license to ADH, Inc. contingent upon showing of <br />liquor liability insurance to the limits required by City ordinance and upon payment of the <br />license fee. <br /> <br />Motion carded. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Case #1: Consider Revocation Of Motor Vehicle Sales License; Case Of <br /> Ramsey Auto Sales (Continued): <br /> <br />Planning Assistant Frolik noted that during the earlier discussion, City Council did not take <br />any formal action with respect to the status of the City license to sell motor vehicles at <br />Ramsey Auto Sales. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember DeLuca to revoke the <br />City license to sell motor vehicles at Ramsey Auto Sales based on the fact that since <br />January 26, 1990, Ramsey Auto Sales has not had a valid State license. <br /> <br />Further Discussion: Councilmember DeLuca directed City Staff to be sure that the new <br />operators of Ramsey Auto Sales are cognizant of the fact that they will be required to apply <br />for a new City license to sell motor vehicles at Ramsey Auto. Councilmember Pearson <br />inquired if there are any provisions whereby the City can recover the costs incurred in <br />administering conditional use permits. Planning Assistant Frolik noted that this same <br />question was raised by the Planning and Zoning Commission some time ago and the City <br />Attorney's opinion was that the City does not have the authority to require such a fee. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Case #17: <br /> <br />Introduction Of Ordinance Establishing A Moratorium On The <br />Siting Of Adult Book Stores: <br /> <br />Mr. Hartley recommended that City Council introduce an ordinance to establish a <br />moratorium on the site of adult book stores. This particular ordinance is nearly identical to <br />the one adopted on April 23, 1990, except the 'emergency' characteristic has been removed <br />from it. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to introduce <br />Ordinance g90-X to establish a moratorium on the siting of adult book stores. <br /> <br />Motion carded.
