Mayor Reimann stated concem with the amount of water, the slow percolation rate and the <br />safety of children. <br /> <br />A brief discussion ensued regarding the history and intent of the ponding area; Lot 1, Block <br />5, Rum Acre Estates <br /> <br />Mayor Reimann inquired about who is liable for any accidents resulting from the water <br />standing on the property. <br /> <br />Mr. Knutson stated that Mr. Jack Miller is the taxpayer on the subject property, however, <br />that part of the lot used for drainage property has been deeded to the City by easement and <br />therefore the City is liable for what happens in that part of the lot. At such time that storm <br />sewer would serve the subject area and the drainage pond would no longer be there, the <br />easement would be deeded back to the property owner. Mr. Knutson also noted that the lot <br />was never represented to be park property. <br /> <br />Jean Schleuter agreed it was never expected to be developed as park land but it was <br />expected to be left as an open area for children to enjoy. She stated her son and another <br />neighbor boy kept it mowed. <br /> <br />Dorothy Stadfelt stated she had originally been told that Outlot B was allocated for park <br />area. <br /> <br />Jean Schlueter stated she had researched minutes and couldn't find documentation <br />regarding City Council being notified and approving the change in drainage plan. She <br />inquired as to how a person could make such a unilateral decision without City Council <br />approval. She felt that Mr. Raatikka had made a mistake and that the City is liable. <br /> <br />City Engineer Raatikka stated he made the decision for a change in drainage plans so as not <br />to destroy mature trees in the area. He also noted the change was an effort to avoid having <br />to construct another outlet into the river which would require a sediment pond. Mr. <br />Raatikka stated that the plans and specifications approved by City council in March, 1990 <br />included the change in the proposed drainage plan. <br /> <br />Shirley Chenoweth, 15220 Salish Street N.W., Ramsey inquired if the percolation test was <br />done before the ponding area was excavated. <br /> <br />City Engineer Raatikka replied that the percolation test was done in the area and it showed <br />no problems. <br /> <br />Richard Schlueter stated he had watched the test being done and it only took a couple of <br />hours. He felt it should have been worth more time. <br /> <br />Mayor Reimann inquired as to who would be responsible for the cost of restoring the <br />ponding area on Lot 1, Block 5, Rum Acres Estates and would the lot then be buildable <br />because of the storm sewer eliminating the need for a drainage easement. <br /> <br />Dorothy Stadfelt commented that installing storm sewer would not be reverting it back the <br />way it was. <br /> <br />Jean Schlueter also stated she wanted the ponding area restored and retained as a drainage <br />easement. <br /> <br />City Council/June 6, 1990 <br /> Page 3 of 5 <br /> <br /> <br />
