Mr. Hartley stated that recognizing Mr. Peterson's intent, it may be in the City's best interest to <br />retain ownership of PIN #10-32-25-44-0009 and sell an easement across it to provide Mr. <br />Peterson with access to PIN #10-32-25-44-0021. Mr. Hartley explained that retaining ownership <br />of PIN #10-32-25-44-0009 and selling an easement across it to Mr. Peterson would facilitate Mr. <br />Peterson's need for access to PIN #10-32-25-44-0021 and retain the City's rights to use that parcel <br />as fight-of-way for future street extension that would not have to be purchased at a later date. <br /> <br />Mayor Reimann indicated that the City Staff has incurred $400.00 in processing this case so far at <br />Mr. Darryl Peterson's request. Mayor Reimann indicated that if Mr. Peterson is willing to <br />reimburse the City the $400.00 for costs incurred to this point, he would be willing to grant an <br />easement across parcel #10-32-25-44-0009 to provide access to PIN #10-32-25-44-0021. <br /> <br />A discussion ensued regarding any obligations that would be placed upon the perspective buyer of <br />PIN #10-32-25-44-0021 with respect to the driveway easement. Mr. Goodrich indicated that the <br />driveway easement across City owned property would not have any more obligations placed on it <br />than any other driveway to a residence. If the property owner subdivides PIN #10-32-25-44-0021 <br />in the future, PIN #10-32-25-44-0009 represents road right-of-way that would not have to be <br />purchased to access the plat. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Peterson to grant an easement to <br />Mr. Darryl Peterson for ingress and egress purposes across PIN #10-32-25-44-0009 upon receipt <br />of a $400.00 payment to the City from Mr. Darryl Peterson. <br /> <br />Further Discussion: Mr. Goodrich indicated that Mr. Darryl Peterson has the right to sell that <br />easement but the City would retain fee title on it. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Cich, Peterson, Pearson and <br />DeLuca. Voting No: None <br /> <br />Case #4: <br /> <br />Report on Status of Drainage in Juniper Woods Addition. <br /> <br />Mr. Raatikka reported that on June 12, 1990, the contractor installed storm sewer and filled in the <br />pond on Lot 1, Block 5, Rum Acre Estates; restoration is proposed to be accomplished at the time <br />restoration of the Juniper Woods plat takes place. Mr. Raatikka stated that the estimated cost of <br />restoration of Lot 1, Block 5, Rum Acre Estates is $4,000.00 and a change order has been <br />prepared to add that project to the Juniper Woods project. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember DeLuca to adopt Resolution #90- <br />06-184 Approving Change Order #3 for Improvement Projects #89-14 and #87-27. <br /> <br />Further Discussion: Councilmember Cich inquired as to what the costs were to dig out the ponding <br />area on Lot 1, Block 5, Rum Acre Estates. Mr. Raatikka replied that the excavation costs were <br />$7,000.00. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Cich, DeLuca, Pearson and <br />Peterson. Voting No: None. <br /> <br />Case #5: <br /> <br />Final Plat of Juniper Woods 2nd Addition. <br /> <br />Mr. Hartley recalled that the developers of Juniper Woods agreed to construct a temporary road <br />during Phase I of that development. That road was to be torn out and reconstructed during Phase <br />II.
