water and street construction in Phase I and the benefit to complete second phase improvements at <br />this time. <br /> <br />City Engineer Raatikka proceeded to review his report dated June 19, 1990 regarding final plat <br />approval of Juniper Woods 2nd Addition. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Peterson to adopt Resolution <br />#90-06-185 Granting Final Plat Approval of Juniper Woods 2nd Addition Contingent upon the <br />Developer Entering into the City's Standard Development Agreement. <br /> <br />Further Discussion: Councilmember Peterson noted that it is proposed to line the ponding area in <br />Juniper Woods 2nd Addition and inquired if that would be creating a hazard. Mr. Raatikka replied <br />that the developer is intending to maintain a water pond in the plat to provide an amenity to the plat. <br />The developer of Juniper Woods 1st and 2nd Addition, Mr. Knutson, was present and indicated <br />that the pond would hold three to five feet of water. Councilmember DeLuca inquired as to who <br />assumes liability for the pond. Mr. Goodrich replied that unless the developer is proven negligent, <br />the City would assume liability for the pond when it accepts the plat.. Mr. Hartley noted that any <br />time the City's liability is tested, it must be proven that the City was negligent. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Pearson, Peterson, Cich and <br />DeLuca. Voting No: None. <br /> <br />Case #6: <br /> <br />Request for State Reimbursement for Airport Study Expenditures. <br /> <br />Finance Officer Sandra Ashley reported that a request for reimbursement of Airport Master Plan <br />and engineering expenses was submitted to MnDOT. In the process of MnDOT's review, they <br />realized that work that had been agreed to verbally by MnDOT was not supported in the contract. <br />Sandra Ashley recommended Council approval of a resolution authorizing the City Administrator <br />and Mayor to submit an amendment to the contract to enable the City to collect additional <br />reimbursement for Airport Master Plan and engineering expenses. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt Resolution <br />g90-06-186 Amending Contract Agreement for MnDOT Participation in Gateway North Industrial <br />Airport Project. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and <br />Cich.
