2298 <br />2299 b. The city shall notify the commissioner of its final decision on the <br />2300 I proposed action within ten (10) days of the decision. <br />2301 c. The action becomes effective when and only when either: <br />2302 1. The final decision taken by the city has previously received <br />2303 certification of approval from the commissioner; <br />2304 2. The city received certification of approval after its final <br />2305 decision; <br />2306 I 3. Thirty (30) days have elapsed from the day the commissioner <br />2307 received notice of the final decision, and the city has received <br />2308 from the commissioner neither certification of approval nor <br />2309 notice of non -approval; or <br />2310 I 4. The commissioner certifies approval within thirty (30) days <br />2311 after conducting a public hearing. <br />2312 d. In case the commissioner gives notice of non -approval of an <br />2313 1 ordinance,earianc c inc i snt plat, _either the applicant or the <br />2314 administrator may, within thirty (30) days of said notice, file with the <br />2315 commissioner a demand for hearing. If the demand for hearing is not <br />2316 I made within thirty (30) days, the notice of non -approval becomes <br />2317 final. <br />2318 1. The hearing will be held in an appropriate local community <br />2319 I within sixty (60) days of the demand and after at least two <br />2320 weeks published notice. <br />2321 2. The hearing will be conducted in accordance with Minn. Stats. <br />2322 § 103G.311. <br />2323 3. The commissioner shall either certify approval or disapproval <br />2324 of the proposed action within thirty (30) days of the hearing. <br />2325 e. Other governmental open space recreational uses. <br />2334 (12) Enforcement. It is declared unlawful for any person to violate any of the terms <br />2335 I and provisions of this cubdivisionsection. Violation thereof shall be a misdemeanor. <br />2336 Each day that a violation is permitted to exist shall constitute a separate offense. <br />2337 a.
