162 damaae to public and private improvements through inundation by <br />163 floodwaters and subsequent expensive construction of storm sewers <br />164 and other public proiects. in the permanent destruction of natural <br />165 resources. loss of water retention facilities. open space and wildlife <br />166 habitats and impairment of public and private water supplies. <br />167 Minimum area requirements for building sites shall be determined in <br />168 accordance with this Code. the standards of the Shoreland Overlay <br />169 District and the Critical Rivers Area Overlay District. <br />170 b. Filling. <br />171 1. A minimum amount of filling may be allowed when necessary.' <br />172 but in no case shall the following restrictions on total amount <br />173 of filling be exceeded. Since the total amount of filling that can <br />174 be permitted is limited, the city, when considering permit <br />175 applications. shall consider the equal apportionment of fill <br />176 opportunity to riparian landowners. <br />177 2. Total filling shall not cause the total natural flood storage <br />178 capacity of the wetland to fall below the proiected volume of <br />179 runoff from the entire area wetland water shed generated by a <br />180 ten-year storm. <br />181 3. Total filling shall not cause the total natural nutrient stripping <br />182 capacity of the wetland to fall below the nutrient production of <br />183 the wetland watershed shed for its proiected development. <br />184 4. Only fill. free of chemical pollutants and organic wastes. may <br />185 be used. Wetlands shall not be used for solid waste disposal. <br />186 5. Grading and filling in overlay district areas or any alteration of <br />187 the natural topography where the slope of the land is toward a <br />188 protected water or a watercourse leading to a protected water <br />189 must be authorized by a permit. The permit may be granted <br />190 subiect to the conditions that: <br />191 i. The smallest amount of bare around is exposed for as <br />192 short a time as feasible. <br />193 ii. Temporary around cover. such as mulch. is used and <br />194 permanent around cover. such as sod. is established. <br />195 iii. Methods to prevent erosion and trap sediment are <br />196 employed. <br />197 iv. Fill is stabilized to accepted enaineerina standards. <br />198 c. The removal of natural vegetation shall be restricted to prevent <br />199 erosion into protected waters. to consume nutrients in the soil. and to <br />200 preserve aesthetics.
