Martin Luther King Day as State law mandates that City Hall be closed on that <br />day and as a result, employees will get a short pay check for that week if they <br />don't claim a vacation day. Mr. Hartley stated that it might be a better part <br />of valor to approve this vacation day in lieu of the fact that he did get <br />language contained in the contract that he would never have expected to get. <br /> <br />Council consensus was a paid holiday for Martin Luther King Day should be held <br />back as a final negotiating item. <br /> <br />Mr. Hartley stated that Item 10.4 provides that an employee has to be at work <br />the day before and the day after a holiday to receive pay for that holiday <br />unless that employee is on vacation or paid leave or has advanced excused <br />absence from the City Administrator. Item 10.5 identifies how regular part- <br />time employees are dealt with with respect to a pro-rata share for holiday pay. <br /> <br />Councilmember Cox noted a correction to Item 10.3; second sentence should read <br />as follows: 'When Christmas Eve falls on a Saturday or a Sunday, the preceding <br />Friday is considered the paid holiday.' <br /> <br />11) Article 11 - Vacation Leave - Mr. Hartley stated that a vacation leave <br />timetable has been included in the contract. If an employee leaves in good <br />standing, they can be compensated for unused vacation leave accumulated to the <br />date of employment separation. The maximum amount of vacation leave that can <br />be accrued is the amount earned in one year. <br /> <br />12) Article 12 - Insurance - Mr. Hartley stated that at final offer time on <br />April 10, he would like to be able to give what was given to the police <br />department, a $10 increase to health insurance benefits. Mr. Hartley stated <br />that he feels the union would accept the 3.8% cost of living with a $10 <br />increase to health benefits. <br /> <br />Council consensus was to increase the health insurance benefit to $150/month <br />and remain with the 3.8% cost of living increase. <br /> <br />13) Article 13 - Jury Duty - Mr. Hartley noted that language has been added to <br />clarify that an employee will be paid for serving as a witness in court when it <br />is required in their capacity as a city employee. Language in this article <br />also provides that when jury is dismissed prior to the end of the employee's <br />work day, the employee will report back to work if practicable. <br /> <br />14) Article 14 - Leave of Absence - Mr. Hartley stated that there is no change <br />in this article from past city policy. <br /> <br />15) Article 15 - Seniority - Mr. Hartley stated that this article acknowledges <br />that some people have been employed by the City longer than others and a copy <br />of that seniority list will be provided to the union. <br /> <br />16) Article 16 - Lay Off - Mr. Hartley stated that he has obtained language in <br />this article that he and the mediator would never have expected to be accepted. <br />The union wanted lay offs to be in order of seniority but Mr. Hartley proposed <br />language that said lay offs would be in order of seniority only when the job <br />relevant qualification factors between employees are equal.
