Further Discussion: Representatives of the church have reviewed the terms of <br />the permit agreement and have no problem with them. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers $orteberg, Cox and <br />Reimann. Voting No: None. Absent: Councilmember Schlueter. <br /> <br />Case #4: Request For Final Plat APProval Of Voltin's Oak Hill Estates; <br /> Case Of Mr. Dale Voltin: <br /> <br />Mr. Dale Voltin and Mr. Jeff Caine were present. <br /> <br />Mr. Raatikka referred to his letter of May 27, 1986 regarding the subject plat, <br />particularly items 5 and 6, requiring streets to be constructed with 4" of <br />gravel and 4' shoulders and that the proposed plans and specs need to be signed <br />by a registered engineer. Mr. Raatikka recommended plat approval contingent <br />upon compliance with items contained in his letter of May 27, 1986. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Cox adopting <br />Resolution #86-70 granting final plat approvaql to Voltin's Oak Hill Estates <br />contingent upon compliance with items contained in City Engineer letter dated <br />May 27, 1986 and entering into a development agreement with the City. (Please <br />refer to resolution file for Resolution #86-70). <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox and <br />Reimann. Voting No: None. Absent: Councilmember Schlueter. <br /> <br />Case #5: <br /> <br />Request For Final P.U.D. Development Plan Approval And Rezonin~ <br /> To Planned Unit Development For River's Bend Plaza; Ca~ Of <br /> River's Bend Properties: <br /> <br />Mr. Lyle McLaughlin was present. <br /> <br />Mr. Raatikka reviewed his May 27, 1986 letter regarding the subject plat with <br />Council. Mr. Raatikka stated that the developer is considering requesting tax <br />increment financing and item ~5 of his letter would be addressed at that time. <br /> <br />Councilmember Cox inquired as to the reason for requesting P.U.D. zoning. <br /> <br />Ms. Norris replied that PUD allows for mixed uses but so does the existing <br />zoning on the property. <br /> <br />Mr. Goodrich stated that Council should not grant PUD zoning with <br />contingencies. <br /> <br />Mr. McLaughlin stated that drainage plans cannot be prepared until the plans <br />for what the shopping center will consist of are complete. Mr. McLaughlin <br />noted that the City has ultimate control of the site; no building permits can <br />be issued until adequate drainage is provided for. <br /> <br />Mr. Hartley stated that a PUD zoning should not be considered the same type of <br />tool as a conditional use permit; PUD is a zone that will permit the developer <br />to move a little closer to boundaries as long as enough open space is provided <br />May 27, 1986 <br /> <br />Page 8 of 18 <br /> <br /> <br />
