Mr. Vasseur's request for a variance to street frontage until the next regular <br />Council meeting at which time Mr. Vasseur should be present to discuss the <br />155th Avenue easement issue. <br /> <br />Further Discussion: Councilmember Cox stated that if Mr. Vasseur is working <br />within a critical time frame, the case can be placed on a more timely Council <br />agenda. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox and <br />Schlueter. Voting No: None. <br /> <br />Discuss Revocation Of Conditional Use Permit To Operate <br /> Automobile Sales And Repair Service; Case Of Mr. Gerald Root: <br /> <br />Mr. Goodrich stated that the property is located on Cry. Rd. #5 and Mr. Root <br />was issued a conditional use permit in May, 1986. Ms. Norris has written and <br />talked to Mr. Root many times regarding his non-compliance with the permit <br />agreement and there has been little, if any, response. It also appears that an <br />additional use is being carried on at the property -- storage of constructions <br />vehicles and equipment. <br /> <br />Ronald Ylitalo - Attorney - Stated that he is present representing Mr. Root and <br />stated that there is not a second business operating at the site; Mr. Root is <br />storing construction vehicles on the site in return for the owner of that <br />equipment surfacing his parking area. Mr. Root is agreeable to having that <br />equipment removed from his property and can have the parking area surfaced <br />within 30 days. With regards to outdoor storage of other than operable <br />vehicles, Mr. Ylitalo stated that he viewed the property and anything stored <br />outside that is inoperable is a temporary situation. Mr. Root is intending to <br />fence the property for screening and protection purposes. Mr. Root states that <br />he will comply with hours of operation. <br /> <br />Mr. Goodrich stated that City Staff feels it is an extraordinary situation when <br />Council has to review a conditional use permit so soon after issuance and <br />serves as evidence that Mr. Root will continue to ignore the conditions of the <br />permit. <br /> <br />Mr. Root stated that he has been very busy; questions why he is being singled <br />out when there are much worse junk storage problem areas in Ramsey than his, <br />i.e., right next door and other places right on Cry. Rd. #5. Mr. Root stated <br />that he intends to have a neat appearing business but he has not had the time <br />to get it that way. Mr. Root noted that there is a problem with proper <br />disposal of tires and he only makes one trip a week to Schwartzman's to dispose <br />of junk motors. <br /> <br />Mr. Goodrich stated that Mr. Root is not being singled out; three-fourths of <br />Ms. Norris' time is spent on similar problems. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to table <br />any action regarding Mr. Gerald Root's conditional use permit until the regular <br /> August 26, 1986 <br /> <br />Page 12 of 25 <br /> <br /> <br />
