Of Mr. Gerald Bauer: <br /> <br />Mr. Bauer was present. <br /> <br />Ms. Norris stated that Mr. Bauer is requesting a simple subdivision of the <br />property located west of State Highway #47 and north of Green Valley Road NW <br />and east of Ford Brook. Mr. Bauer is proposing to split off two 2-1/2 acre <br />lots and the remainder of the property will be platted as outlots. The two <br />lots would have common access from Hwy. #47 that has been approved by MN/DoT. <br /> <br />Mr. Bauer stated that he intends to build a home on Outlot C. <br /> <br />Ms. Norris stated that outlots are not considered buildable. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to adopt <br />Resolution #86-124 approving Mr. Gerald Bauer's request for final plat approval <br />of Green Valley Estates with Outlot C to be redesignated as Lot 3 of Block 1 <br />and contingent upon Mr. Bauer entering into a development agreement with the <br />City. (Please refer to resolution file for Resolution #86-124). <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox and <br />$chlueter. Voting No: None. <br /> <br />~ AppearaB¢~ By M~. and Mrs. Gary Rice Regardin~ Conditional Use <br /> <br />Mrs. Rice and her attorney, Barbara Gislason were present. <br /> <br />Ms. Gislason stated that as an attempt to figure out why Mrs. Rice's request <br />for a conditional use permit was denied, she spent a lot of time reviewing all <br />related documentation and conditions followed by Ramsey with respect to home <br />occupations. Ms. Gislason stated that she assumes Council would not turn down <br />a request, that meets City criteria, based on personal view points of not <br />wanting business uses in a residential neighborhood. Mrs. Rice is a woman with <br />preschool age children requesting a permit for a typical cottage industry, <br />measuring garments, historically done in the home. According to past City <br />records, other women in similar situations, as recently as March and May of <br />1986, have been approved for conditional us epermits to operate accounting and <br />word processing businesses in their homes with a 2 year time frame limit. Ms. <br />Gislason stated that if Mrs. Rice would have at least been given the same <br />consideration in her case, it would have given her the opportunity to operate <br />the business from her home and add to the family income until her children <br />reach school age. Ms. Gislason stated that the only issue she could find as <br />probably being a concern of Council was the projected increase in traffic to <br />the neighborhood created by the business. Mrs. Rice is a wedding consultant <br />and in that capacity she goes to the clients home; as an extension of that <br />business, Mrs. Rice wants to provide a tuxedo rental service. The extent of <br />commercial vehicles entering the neighborhood would be a UPS truck delivering <br />garments to Mrs. Rice according to UPS' routine delivery schedule in Ramsey. <br />The members of a wedding party requiring a tuxedo would come to Mrs. Rice's <br />home to choose suit styles from a catalog and be measured; the suits would be <br />returned to Mrs. Rice's home. Mrs. Rice has canvassed the neighborhood and <br />obtained signatures on a petition from everyone, except one neighbor that was <br /> August 26, 1986 <br /> <br />Page 14 of 25 <br /> <br /> <br />
