4) Adopt Resolution #86-169 approving monthly bills for October, 1986. <br /> <br />5) Adopt Resolution #86-170 approving Records Retention Schedule. <br /> <br />6) <br /> <br />Reappoint Park and Recreation Commissioners John Lichter~, Don Lokker <br />and Ron Hetland to three year terms expiring October 31, 1989. <br /> <br />7) Approve Lake Animal Care, Inc. animal control contract. <br /> <br />Further Discussion: Councilmember DeLuca noted that he will vote 'yes' to the <br />Consent Agenda but that will include an abstention to Item #4 (approval of <br />monthly bills for October, 1986) as the copy in his agenda is too light to <br />read. Councilmember DeLuca stated that he will also be abstaining to Item #'s <br />1.a, 1.b and 1.c (Council minutes) as those meetings were prior to his taking <br />office. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, DeLuca <br />and Schlueter. Voting No: None. Absent: Councilmember Cox. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1 Discuss Revocation Of ConditiOnal Use Permit To Operate Automobile <br /> Sales And Repair Service~ Case Of Mr. Gerald Root; <br /> <br />Ms. Norris explained that Council had granted a conditional use permit and <br />subsequently, a series of extensions to get into compliance, to Mr. Root. Ms. <br />Norris stated that as of Monday, October 20, 1986, it appears that Mr. Root has <br />met some of the requirements, but the parking area has not yet been surfaced in <br />a manner that meets City Code. Per Council's direction of September 30, 1986, <br />findings of fact have been drafted for the revocation of the conditional use <br />permit. <br /> <br />Mr. Ronald Ylitalo, attorney representing Mr. Gerald Root, was present and <br />stated that Mr. Root wishes to contest item #14 of the proposed findings <br />regarding surfacing of parking area. Mr. Ylitalo stated that at the September <br />30, 1986 meeting, Mr. Root was advised that code did not necessarily mean <br />blacktop or concrete surfacing. <br /> <br />City Attorney Goodrich stated the ordinance reads "hard, dust free surface". <br /> <br />Mr. Ylitalo stated that he feels his client has met that requirement. <br /> <br />City Engineer Raatikka stated that the material Mr. Root used to surface his <br />parking area is difficult to compact and there would always be loose material. <br /> <br />Mr. Goodrich stated that there has been an improvement to the property <br />appearance with respect to storage of equipment and vehicles; it is a question <br />of whether or not Council feels the materials used on the parking area <br />adequately meet the conditions of the conditional use permit. <br /> <br />Mayor Reimann suggested that the case be tabled another 30 days and during <br />the interim, City Engineer Raatikka can evaluate the material used on the <br /> October 28, 1986 <br /> <br />Page 6 of 21 <br /> <br /> <br />
