Councilmember Tossey asked if it would address current situations. <br />Senior Planner Gladhill stated it would apply to all residential parcels. If in existence, the use <br />would become lawful nonconforming so it would not stop the use but would prevent it from <br />becoming too intense for the surrounding neighborhood. <br />Mayor Ramsey asked how it will be enforced to assure they are family members. <br />Senior Planner Gladhill indicated it would be on a complaint basis and the residents would be <br />required to provide evidence they are family members. <br />Planning Consultant Goodroad stated this is usually something cities try to avoid getting into. <br />She noted the State overrides what local municipalities can do with group homes, similar to <br />telecommunication towers. She felt the best way is to notify nearby neighbors; however, it often <br />become reactionary so staff needs to help residents and address things like parking or outdoor <br />storage. It was noted there are tools in place, but from an actual use standpoint, the City's ability <br />is limited. <br />Councilmember Elvig stated another tool is to require licensing so the City can pull the license or <br />not renew if there is an unresolved violation. He noted there had been a similar problem when <br />19 people were found to be living in one trailer home. <br />Mayor Ramsey stated he sees the City's ability to take action and help residents has been <br />curtailed by the State and it is his job to tell the State that is not acceptable to the residents of <br />Ramsey and try to affect change. He stated support to draft a Council resolution to voice <br />dissatisfaction with the State law. <br />Senior Planner Gladhill indicated a resolution would be helpful; however, there are also Federal <br />Fair Housing Act standards. <br />Councilmember Backous stated he supports Mayor Ramsey's suggestion to consider such a <br />resolution at a future meeting. <br />Councilmember Wise concurred and suggested the resolution also be sent to other <br />municipalities. He stated his main concern is with drug and alcohol treatment. <br />Planning Consultant Goodroad suggested staff contact other communities to determine if they <br />also have similar concerns.
