Dan Floria, 16955 Nutria, Lot 4 Autumn Meadows stated if you look at the records, there have <br />been a lot of calls to the police about 168th Street and high speed traffic. He stated there was also <br />a lot of people tearing up the grass through the park with four-wheelers. He indicated if the City <br />builds a road through there it will amplify the situation as well as encourage additional high- <br />speed traffic. <br /> <br />Mark Anderson clarified that what he is proposing is not to avoid a second access to the <br />development, but to avoid a through street that would generate additional traffic. <br /> <br />Chairperson Nixt indicated the City tries to provide additional access if they can, but in this case <br />they cannot. He does not think they should prevent development because of that. He would <br />recommend approving the sketch and try to modify the road by Mr. Diedrich, and then he could <br />live with the plan. <br /> <br />Commissioner Johnson added the caveat that staff should further speak with the City Attorney <br />and see what can be done through the park. He stated the City can vacate roads; they should be <br />able to vacate parkland. <br /> <br />Mr. Brand, 17045 Tiger, stated he owns the property to the north. There is an easement that runs <br />all along his south property line. On his abstract, it says the easement is for a road. <br /> <br />It was recommended the property owner try to find the document that supports the easement to <br />determine the intended use. <br /> <br />Commissioner Brauer asked if the reason Mr. Brand brought this up is because of the possibility <br />of running a street through his property. <br /> <br />Mi'. Brand indicated he may be open to that, as he bought the land for investment. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Reeve to approve the sketch plan <br />contingent on compliance with City Staff Review Letter dated March 28, 2003 and recommend <br />that the developer proceed to the preliminary plat stage, subject to staff determining if it is <br />permissible to vacate parkland to address egress issues and at least look at reconfiguration of <br />170°~ Avenue to reduce the impact on Mr. Diedrich's property. <br /> <br />Further Discussion: Chairperson Nixt stated he also wanted to direct staff that private property <br />should not be taken and they should look at parkland for access purposes. Associate Planner <br />Walcl asked if the Commissioners wanted to give comments on the cluster development <br />discussed by the City Council. She stated the Council's idea was to recolnmend cluster homes <br />until someday when urban services are extended to that area. Commissioner Johnson stated he <br />would recommend going forward with the current plan. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Reeve, Brauer, <br />Shepherd, Van Scoy and Watson. Voting No: None.
