Mr. Hartley stated that Mr. Arnold Klar is requesting an amendment to the conditional use
permit issued in 1984 in order to maintain 4 rather than 3 delivery trucks on his property at
16020 Potassium Street N.W. In addition, Mr. Klar is requesting that the permit also list
accessory equipment that has been maintained on the property since 1984 relating to the
firewood sales business.

Mayor Reimann stated that if the operation is growing, it is time to consider relocating it out
of a residential area. Mayor Reimann also noted that the conditional use permit issued in
1984 requires that the firewood be stacked in the rear of the property; Mr. Klar wood pile
extends into the side yard. Mayor Reimann stated that the Fire Chief has also expressed
concerns with the manner in which the wood is stacked.

Mr. Klar stated that he has positioned the woodpile for easiest access by fire trucks; the
wood is stacked in a U shape to conceal the equipment from public view.

Councilmember DeLuca stated that he viewed the property and if the wood were stacked in
the rear yard, the public would have a clear view of all the equipment. Councilmember
DeLuca inquired why another delivery truck is necessary when Mr. Klar is to be the only
employee.

Mr. Klar stated that he needs the 4 delivery truck to serve as a backup to the others in the
event of mechanical breakdown. Mr. Klar also mentioned that his cousin helps him deliver
wood on weekends during busy times.

Council proceeded to review and amend the proposed findings of fact as follows:

Item//15 should indicate that the proposed increase in delivery trucks will not be
harmonious with the Comprehensive Plan.

Item #10 should indicate that the increase in delivery trucks will increase traffic to
and from the subject property and that the Applicant has stated that there is an
additional weekend employee.

Amend Item #13 to indicate that the increase in vehicles will be unduly dangerous to
persons residing in the area.

Add an item to indicate that the additional truck will tend to increase the size of the
firewood sales operation in the residential neighborhhood.

Add an item to indicate that the Applicant has stated that the additional delivery truck
is necessary to serve as a backup when one of the three regular vehicles is not
operating.

Motion by Councilmember Pearson and seconded by Councilmember Cich to adopt
Findings of Fact #0246, as amended, relating to Mr. Arnold Klar's request for a
conditional use permit to maintain one additional delivery truck on his property at 16020
Potassium Street N.W.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich
and Peterson. Voting No: None.

City Council/April 25, 1989
