Case #6: Request Council Direction Regarding Possible Condemnation Of
Land Adjacent To The ProPosed Gordon's Gardens 2nd Addition:

Mr. Banwart stated that Mr. Gordon is proposing to develop Gordon's Gardens 2nd Addition.
The Anoka County Department of Transportation has reviewed the sketch plan and indicated that
upgrading an existing driveway onto County Road #22 to serve Lots 1 and 2 is acceptable. The
County, City Staff and the Planning and Zoning Commission would prefer the extension of 180th
Avenue N.W. versus allowing an additional driveway onto Cty. Rd. #22 to access Lot 4. Mr.
Gordon has indicated that the property owner is willing to sell the easement for an extension of
180th Avenue at a substantial price. On May 2, the Planning and Zoning Commission requested
that the City Staff determine the feasibility and cost responsibility for condemnation. The City
Attorney has determined that condemnation is within the realm of City efforts; cost of
condemnation would be the responsibility of the subdivider; and in this case, the cost of
condemnation could approach that of the asking price. It is recommended that City Council direct
City Staff to assist in a negotiated purchase of the easement necessary for the extension of 180th
Avenue N.W. If that effort fails, Mr. Gordon can determine if he wishes to proceed by requesting
condemnation of the easement.

Councilmember DeLuca noted that it might also be of benefit to have Mr. Gordon dedicate
easements to the south boundary of Gordon's Gardens 2nd Addition that could eventually provide
a connection to Ermine Blvd. N.W., should it become necessary in the future.

Motion by Councilmember Pearson and seconded by Councilmember Peterson to direct City Staff
to proceed with the negotiated purchase of necessary lands for the extension of 180th Avenue
N.W. and to proceed in the event of successful purchase, the vacation of portions of the cul-de-
sac, which would be come unnecessary in the event of the extension of 180th Avenue N.W.
Furthermore, the subdivider would assume financial responsibility for the negotiated purchase and
would also be financially responsible for the restoration of the cul-de-sac prior to vacation to those
benefitting property owners residing outside of the proposed subdivision as part of the
Development Agreement for Gordo's Gardens 2nd Addition.

Further Discussion: Mr. Gordon stated that he is agreeable to providing easements for the
continued extension of 180th Avenue to the south.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich and
Peterson. Voting No: None.

Case g7: Amended Development Permit For Custom Coach RV, Inc.:

Mr. Banwart stated that on March 14, the City granted site plan approval to Custom Coach to
remodel and add onto an existing building located at 6845 Hwy. 4/10 N.W., formerly the
McGregor's Truck Stop. On April 5, the City was advised by Custom Coach that certain soils had
been contaminated by petrolium products leaking from underground storage tanks and lines prior
to the time they acquired the site. On May 10, Custom Coach indicated that they wanted to proceed
with the addition and remodeling to the building but desired some relief from the site plan time
schedule in consideration of the fact that the site, at a later date, may require excavation because of
the contaminated soils. Based on this information, City Staff is recommending approval of an
amended development permit for Custom Coach.

Motion by Councilmember Pearson and seconded by Councilmember Peterson to approve the
amended development permit for Custom Coach RV, Inc.

City Council/May 23, 1989
