Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-02- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST <br />FOR A VARIANCE TO THE FRONT YARD SETBACK FOR AN ACCESSORY <br />STRUCTURE.., TO CONSTRUCT AN ACCESSORY STRUCTURE CLOSER TO THE <br />FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE, AND TO THE <br />DESIGNATED SETBACK FROM A NATURAL ENVIRONMENT LAKE. <br /> <br /> WHEREAS, Jeff and Barbara Rockow, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 (Accessory Structures), 9.20.11 (R-1 <br />Residential DiStrict), and Section 9.21.04 (Shoreland Overlay District Development Standards) <br />of the RamseyiCity Code to construct an accessory structure closer to the front property line than <br />the principal Structure and to infringe on the designated setback from a 'Natural Environment <br />Lake on the prroperty generally known as 18015 Ute St. NW and legallY described as follows: <br /> <br />That part i of the north half of the Northeast Quarter of Section 1, Township 32, <br />Range 25, Anoka County, Minnesota described as follows: <br /> <br />From a point on the east line of said north half of the Northeast Quarter said point <br />being 12.76 chains south of the Northeast comer thereof, said point also being the <br />centerline~ of public road: thence south 82 degrees, 30 minutes west on said center <br />line of said road a distance of 1010.0 feet; thence northerly parallel with the east line <br />of said Section 1, a distance of 451.0 feet to the actual point of beginning of the tract, <br />to be des~ibed, said last described line also being the easterly line of road easement; <br />thence eakterly parallel with the north line of said Section 1, a distance of 155.00 <br />feet; thence northeasterly deflecting to the left 40. degrees, 47 minutes 0 seconds a <br />distance 6f 191.87 feet to its intersection with a line drawn parallel with and distant <br />700.0 feet; west of the east line of said Section 1; thence northerly along said parallel <br />line a distance of 101.75 feet to its intersection with a line drawn parallel with the <br />north line,of said Section 1, distance 227:0 feet north from the point of beginning as <br />measuredatong a line parallel with the east line of said Section 1; thence westerly <br />along said parallel line a distance of 301.59 feet to its intersection with Said line <br />drawn nogherly and parallel with the east line of said Section 1 from the 'point of <br />beginning; thence southerly along said parallel line a distance of 227.0 feet to the <br />point of beginning. Together with an easement of access over a strip of land 30 feet <br />in width ~extending from the aforementioned Public road on the south and to the <br />north line of the tract herein described on the north and the easterly line of this <br />easement 'extending from a point on the centerline of the said public road which is <br />1010 feet~ from the east line of said Section 1 when measured along the said <br />centerline; and extending north to the northwest comer of the tract herein above <br />described, <br /> <br />(Subject Property) <br /> <br />11 <br /> <br /> <br />
