NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on February 5, 2004, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned R-1 Rural Developing and is located outside the <br /> Metropolitan Urban Service Area. <br /> <br />3. That the Subject PropetV is approximately 1.36 acres in size. <br /> <br />4. That the Subject Property is surrounded by properties also zoned R-1 Rural Developing. <br /> <br />5. That the Subject Property is within the Shoreland Overlay District for Rogers Lake, which is <br /> classified in the Ramsey City Code as a Natural Environment Lake. <br /> <br />That Section 9.21.04 (Shoreland Overlay District Development Standards) of the Ramsey <br />City Code requires a structure setback of 200 feet from the Ordinary High Water (OHW) <br />mark of Rogers Lake. <br /> <br />That Section 9.11.02 (Accessory Structures) of the Ramsey City Code does not permit the <br />construction of accessory structures closer to the front property line than the principal <br />structure. <br /> <br />That Section 9.20.11 (R-1 Residential District) of the Ramsey City Code states that the front <br />yard setback, for lots zoned as Rural Developing, is fol~ (40) feet or same as principal <br />structure, whichever is greater. <br /> <br />9. That the Applicant is a self-employed contractor and currently brings commercial equipment, <br /> specifically several trailers, home after a job is completed. <br /> <br />10. <br /> <br />That City Code does allow self-employed contractors to bring commercial equipment to their <br />property as tong as it is stored indoors or kept in the side or rear yard and properly screened <br />from public roads and adjacent properties. <br /> <br />11. That the Applicants want to construct an accessory structure to store these trailers in <br /> compliance with City Code. <br /> <br />12. That the topography in the rear yard steeply slopes down to Rogers Lake. <br /> <br />13. That the topography in the side yard, to the north of the principal structure, also slopes down <br /> toward the lake, although not as sharply as the rear yard. <br /> <br />14.
