15. That there iis a retaining wall along the southern edge of the driveway that would prevent <br /> access fror~ the existing driveway to the structure if it were constructed south of the principal <br /> structure. <br /> <br />16. That the Principal structure on the Subject Property is approximately ninety (90) feet from the <br /> front property line. <br /> <br />17. That on the adjoining lot to the north, the principal structure is setback approximately forty <br /> (40) feet from its front property line. <br /> <br />18. That the Applicant is proposing to construct an acces, sory building that will be approximately <br /> thirty (30) feet from the front property line and 123 feet from the lakeshore. <br /> <br />19. That the s0:ucture could be shifted back ten (I0) additional feet to comply with the district <br /> minimum and to match the setback of the neighboring house to the north without requiring an <br /> inordinate ,amount of additional fill to level out the site. <br /> <br />20. That the MN DNR reviewed the site plan and have no objection to the requested setback of <br /> 123 feet. While the MN DNR favors the 123 foot setback, they would not object to a reduced <br /> setback of i 13 feet. <br /> <br />21. That the construction of the detached accessory building will comply with all applicable <br /> Building Codes. <br /> <br />22. That the e~:terior finish is required to be of the same general design and materials as the <br /> home. <br /> <br />23. That the Applicants have stated that the accessory structure will meet all height restrictions as <br /> established in City Code. <br /> <br />24. That in the R-1 Rural Developing District, properties are permitted a maximum of two (2) <br /> driveways and the Subject Property currently has one (1) existing driveway. <br /> <br />25. That the Applicants have stated that a second driveway would be installed to access the new <br /> building. <br /> <br />26. That there }tre special conditions that apply to the Subject Property that do not generally apply <br /> to other PrOperties in the district; namely, the property abuts Rogers Lake, currently classified <br /> within thel city limits of Ramsey as a Natural Environment Lake, which has a structure <br /> setback of 200 feet (this essentially eliminates the opportunity for this landowner to construct <br /> any type of structure on the property). Also, the side/rear yard topography slopes down to the <br /> lake shorei gradual at first and then more severely, and finally, there are a number of mature <br /> trees that would require removal to locate this structure south of the principal dwelling. <br /> <br />27.
