REQUEST FOR SITE PLAN REVIEW FOR <br />MALLARD PONDS OFFICE BUILDING <br />CASE OF BULOW INC. <br /> By: Patrick Trudgeon, Principal Planner <br /> <br />CASE # q <br /> <br />Background: <br /> <br />Bulow Inc. is proposing to construct a 6,000 square foot multi-tenant office building on <br />at the northeast corner of Dysprosium St. and County Highway 116. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Site plan <br />City Staff review letter dated September 27, 2002 <br /> <br />Notification: <br /> <br />Site Plans are not required to be subjected to public hearings. However, the applicant is <br />requesting a variance from green space requirements and property owners within 350 feet <br />have been notified of the development. <br /> <br />Observations: <br /> <br />The applicant is proposing to develop a one-story multi-tenant office building consisting <br />of 6,000 square feet. The site plan indicates the building will be split into four 1500 <br />square foot office spaces. <br /> <br />The site is currently zoned Planned Unit Development (PUD). The Development <br />Agreement for the Mallard Ponds subdivision, which this lot is part of, contained language <br />that allowed the subject property to be developed as a commercial lot. The Development <br />Agreement allows for the subject property to be developed with a use allowed under <br />either a B-1 or B-2 Business zoning classification. Multi-tenant office uses are allowed in <br />both the B-1 and B-2 Business Zoning Districts. <br /> <br />The building location exceeds the 35-foot front and rear yard and 20~foot side yard <br />setback requirements. City Code requires a 20-foot green space area adjacent to all public <br />roads. The site plan ~hown does not meet this requirement. The parking area is shown as <br />close as ten feet from the edge of the right-of-way. In addkion, City Code requires the <br />developer to provide a 40-foot landscape buffer along the property line when adjacent to a <br />residential area, as is the case on the eastern border of the site. The site plan as shown <br />does not meet this requirement. The applicant has applied for a variance from both the <br />20-foot green space and 40-foot buffer area requirements. The variance will be considered <br />at the October 3, 2002 Board of Adjustment meeting. <br /> <br /> <br />
