Further Discussion: Mr. Goodrich stated that the City Engineer will determine an appropriate <br />amount for the letter of credit; it is suggested that the letter of credit amount be reviewed every two <br />years with respect to rising construction costs; the developer would be relieved of the letter of <br />whenever he develops the road extensions. Mr. Opsahl stated that it seems so wasteful to develop <br />roads to property boundaries when none of the abutting property owners have intentions to <br />develop. Mr. Putnam stated that Mr. Opsahl should also be relieved of the letter of credit in a <br />situation where abutting property develops in a way that does not require the extension of streets in <br />Alicia Addition. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and <br />Cich. Voting No: None. <br /> <br />Case #8: Request For Preliminary Plat Approval For Nature View Addition: <br /> <br />Mr. Banwart stated that the proposed plat of Nature View Addition consists of approximately 70 <br />acres to be developed with 19 single family lots. City Staff recommends preliminary plat approval <br />and that the developer initiate a conditional use permit for mining and grading with the borrow <br />material to be obtained from the Oakwood Hills Addition; this would involve obtaining a release <br />from the developer of Oakwood Hills to mm over the grading and mining permit for Oakwood <br />Hills to the the developer of Nature View. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Pearson to approve the <br />preliminary plat of Nature View Addition and to obtain a release from Mr. David Schulte to turn the <br />grading and mining permit for Oakwood Hills over to Mr. Jon Rambosek, developer of Nature of <br />View Addition. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Peterson, Pearson and <br />Cich. Voting No: None. <br /> <br />Case g9: <br /> <br />Request For A Conditional Use Permit To Operate A Commercial Dog <br />Kennel; Case Of Mr. Bret Scott: <br /> <br />Ms. Frolik stated that the Planning and Zoning Commission conducted a public hearing regarding <br />Mr. Scott's request for a conditional use permit to operate a commercial dog kennel at his home <br />and recommended approval of the request. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Peterson to adopt Findings <br />of Fact #0259 relating to Mr. Bret Scott's request for a conditional use permit to operate a <br />commercial dog kennel at 7910 173rd Avenue N.W. in the Rural Residential District. <br />Further Discussion: Councilmember DeLuca noted that the findings of fact indicates there will be <br />10 runs for 10 dogs; the site plan only shows 7 runs. Ms. Frolik stated that there must be an error <br />on the site plan as Mr. Scott indicated each dog would have it's own run. Mr. Goodrich noted that <br />Mr. Scott is purchasing the property on a contract for deed and requested that Ms. Frolik obtain the <br />signature of the fee title owner on the conditional use permit application. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and <br />Cich.
