Voting No: None. <br /> <br />Case #4.A: Discussion Regarding Vacation Of Drainage Easement On Lot 3, <br /> Block 5, Whispering Pines Estates; Case Of Wendi Jarson: <br /> <br />Mr. Goodrich recalled that on July 11, 1989, City Council approved vacating the drainage <br />easement on Lot 3, Block 5, Whispering Pines Estates and entering into an agreement with the <br />Jarson's for installation of storm sewer improvements. That agreement required that the Jarson's <br />provide the City with a recordable hold harmless agreement. Since that time, the Jarson's <br />mortgage company has indicated that it will not grant a home loan or allow the closing on the <br />property with a hold harmless agreement attached to the title. Mr. Goodrich recommended <br />amending the agreement with the Jarsons to delete that part which requires that the hold harmless <br />agreement be recorded. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich to adopt Resolution <br />#89-07-178 to amend Resolution #89-07-156 to vacate the drainage easement on Lot 3, Block 5, <br />Whispering Pines Estates. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, Pearson, Cich and <br />DeLuca. Voting No: None. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich authorizing the City to <br />enter into an agreement with Richard and Wendi Jarson which shall indemnify and hold the City <br />harmless from water and flooding damages which may occur to the structures built on the City's <br />original drainage easement on Lot 3, Block 5, Whispering Pines Estates. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Peterson, Cich and <br />Pearson. Voting No: None. <br /> <br />Case #5: Request For Final Plat Approval For Dellwood Hills Addition: <br /> <br />Mr. Banwart recalled that City Council granted preliminary plat approval to Dellwood Hills on <br />June 27, 1989 contingent upon the paving of Bison Street N.W. from 171st to County Road #63. <br />City Staff is recommending tabling action on the request for final plat approval of Dellwood Hills <br />until the feasibility report for paving Bison Street is completed. <br /> <br />Councilmember DeLuca inquired as to what the status and future plans are for what appears to be a <br />street easement directly south and adjacent to Dellwood Hills; if that street is ever developed, there <br />will be homes bordered by streets on two sides. <br /> <br />Mr. Banwart stated the property owner to the south does have a preliminary sketch plan for <br />subdividing the property; the sketch indicates that the eventual urban development of that property <br />will result in lots not being bordered by streets on two sides. <br /> <br />Mr. Raatikka noted that the easement to the south of Dellwood Hills is a private easement. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Peterson to table action on Mr. <br />Lee Hennen's request for final plat approval of Dellwood Hills Addition. <br /> <br />Motion carried.
