Voting No: None.

City Council recessed at 9:30 p.m.

Mayor Reimann called the meeting back to order at 9:37 p.m.

Case #6: Nudity Ordinance:

Mr. Goodrich noted that City Council has been provided with a proposed Nudity
Ordinance that will be presented to City Council at it's next meeting for consideration of
introduction.

Case #7: Adopt Ordinance Adopting The Minnesota State Building Code:

Building Official Glyn Huff was present and stated that in reviewing the building codes, it
came to the attention of City Staff that the State Building Code does not make any
exceptions to the 65% plan review fee; the City is currently charging 45% for residential
plan reviews and 65% for commercial plan reviews. City Staff is recommending adoption
of an ordinance to bring the City into compliance with State Building Code with respect to
plan review fees and establishing a procedure of annually reviewing that fee and amending
it by resolution. Glyn noted that it is not mandatory for cities to adopt the Uniform
Building Code (UBC).

Councilmember DeLuca inquired as to why the City can't adopt just parts of the UBC.

Glyn Huff replied that by not adopting the UBC, the City has the potential to sacrifice
health, safety and welfare because the code is constantly changing.

Motion by Councilmember Pearson and seconded by Councilmember Peterson to adopt
Ordinance #89-27 adopting the Minnesota State Building Code.
