Case #4: Discussion Re_~ardin~ Fencing Requirements For Pondi~g Areas: <br /> <br />Ms. Norris stated that the City has been involved in a couple of lawsuits <br />regarding non-fenced storm water retention areas. Ms. Norris stated that <br />the City Attorney is concerned that the requirement for fencing is not <br />specific enough and may be creating a greater liability than if fencing <br />were not required or addressed at all. <br /> <br />Commissioner Deemer agreed that the requirement creates liability and to <br />follow the requirement, the City would have to fence in casual ponding <br />created by rainfall. <br /> <br />Commissioner LaDue agreed that a liability is created by requiring the <br />fencing. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to <br />recommend modification of the first paragraph of Section 170.015G of the <br />City Code by deleting "and other man-made storm water retention basins". <br /> <br />Further Discussion: Commissioner Hendriksen presented a scenario of a <br />developer installing a concrete bunker for proper water capacity in a <br />subdivision and inquired if it would be more appropriate to not require <br />fencing unless deemed necessary. Commissioner Deemer replied that if the <br />property is not deeded to the City, the liability lies with the developer <br />and he should act accordingly. <br /> <br />Motion carried.
