special Planning and Zoning Commission meeting on August 19, 1986 at 7:30 p.m.

Motion carried. Voting Yes: Chairman Peterson, Commissioners Zimmerman,
Howell, Deemer and LaDue. Voting No: None. Absent: Commissioners Shumway
and Hendriksen.

Discussion Re~ardin~ Plants And ThinEs:

Commissioner Deemer referred to page 16 of July 22, 1986 Council minutes and
noted that City Council reversed Planning and Zoning action in the case of
Plants and Things; Councilmember Cox aimed comments at Commissioner Deemer in
particular. Commissioner Deemer stated that on March 19, 1986 there was a
special Planning and Zoning meeting (which happens to be the day construction
of the new building began at Plants and Things), at which time he brought it to
the attention of the P&Z and City Staff that the building was not up to code.
For various reasons, construction of the building was never stopped.
Commissioner Deemer stated that Mr. Hickman relied upon pacing by the building
inspector to determine that setbacks were met and the problems multiplied from
that point on. Commissioner Deemer stated that he attempted to contact the
Mayor and could not get in touch with the City Attorney until it was too late
to stop construction. Commissioner Deemer stated that he did talk to former
Building Inspector Clayton Berg and Mr. Berg claims that Mr. Hickman first
applied for a building permit when he was still on staff at Ramsey; he told Mr.
Hickman that a certified site plan was required. Therefore, Mr. Hickman did
know what was required but took advantage of a loop hole and erratic conditions
at City Hall. Commissioner Deemer noted that on July 22, 1986, Councilmember
Cox abstained from voting on an issue because of a personal disagreement with
one of the participants in the case. On that basis, Councilmember Cox should
not vote on issues that have participants with which he has a personal
agreemeent; maybe Mr. Cox should not be on Council if he can't separate
personal issues from business. Commissioner Deemer stated that he resents
Councilmember Cox' inference that he is 'picking on Mr. Hickman'.

Ms. Norris stated that she and Councilmember Cox have met with Mr. Hickman
regarding items of concern listed in City Attorney memo dated June 3, 1986.
Mr. Hickman agreed to surface parking lot and driveways on his own time line;
to appropriately mark parking areas, improve exterior appearance of new
structure and provide a non-certified site plan.

Motion by Chairman Peterson and seconded by Commissioner Howell to recommend
that Mr. Larry Hickman be required to fulfill the certified site plan
requirement, just as any other person in Ramsey is required to do; and that if
any variances from that site plan requirement are granted, the reasons for
doing so be spelled out in motion form.

Further Discussion: Chairman Peterson stated that information gained from the
certified site plan (lot dimensions, building size and location) determine the
amount of parking area that will be required; reasons for waiving that
requirement should be public record.

Amendment by Commissioner LaDue and seconded by Commissioner Zimmerman
acknowledging that Commissioner Deemer was not acting independently beyond his
authority as a member of the Planning and Zoning Commission; that Commissioner
August 5, 1986
