stated that the reason he is requesting the subdivision is because he is <br />applying for a second mortgage and only wants to remortgage the home and one <br />acre of property. <br /> <br />~he Commission replied that the new parcel would be landlocked and subdivision <br />would be allowed if the adjacent property owner would provide a 66' road <br />easement to access the newly created parcel and that roadway was improved to <br />meet City standards. <br /> <br />Commissioner LaDue advised Mr. Fischer that subdividing is not necessary to <br />remortgage a portion of the property; the second mortgage need only contain a <br />legal description of that part of the property to be included in the second <br />mortgage. ~his procedure is within the law as a second mortgage is not a <br />transfer of title. <br /> <br />Mr. Fischer stated that if in the future the City desires to purchase a portion <br />of his property, the price will reflect the denied subdivision and the <br />additional interest costs incurred to remortgage the entire parcel rather than <br />just one acre. <br /> <br />Motion by Commissioner Shu~way and seconded by Commissioner Howell to deny Mr. <br />Fischer's request for a metes and bounds subdivision of his property located at <br />15113 Nowthen Blvd. on the basis that the subdivision would create an <br />inaccessible lot. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Shumway, Deemer, <br />Zimmerman, Howell and LaDue.
