Ms. Norris stated that Mr. Kurak has withdrawn his request. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner LaDue to table <br />this case until the special Planning and Zoning meeting scheduled for February <br />19, 1986. <br /> <br />Motion carried. Voting Yes: Chairman Peteron, Commissioners LaDue, Deemer, <br />Zimmerman, Howell, Shumway and Hendriksen. Voting No: None. <br /> <br />R~_uest Fo~...Sr~a_eia] Plannina And Znning._Ma~kin9.- Case <br /> Chuck Pearson: <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Howell to schedule a <br />special Planning and Zoning meeting on February 19, 1986 at 7:30 p.m. to <br />consider Mr. Chuck Pearson's request for a conditional use permit to operate an <br />automobile body repair business in an I-1 Industrial District. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners LaDue, Deemer, <br />Zimmerman, Shtm~way, Howell and Hendriksen. Voting No: None. <br /> <br />Commissioners Deemer and Zimmerman reported on a zoning seminar they attended <br />sponsored by the University of Minnesota Extension Service. <br /> <br />Commissioner Zimmerman stated that at the seminar it was learned that: <br /> <br />1. Rezoning by the city must be supported by justification. <br /> <br />2. ~here may be legislation requiring farmers and developers to cut <br /> down on soils loss. <br /> <br />3. Utilization of Special Use Permits versus Conditional Use Permits <br /> can be ruled by the courts as discrimination. <br /> <br />Chairman Peterson inquired if it would be possible to encourage legislators to <br />amend the law to allow for special use permits. <br /> <br />Ms. Norris stated that she has discussed this issue with the League of <br />Minnesota Cities and Mr. Lefevere; they both say that one of the conditions of <br />the conditional use permit can be duration, as long as it is reasonable. <br /> <br />Commissioner Zimmerman stated that this Commission should review the City's <br />Comprehensive Plan annually. <br /> <br />Mr. David Hartley agreed with Commissioner Zimmerman's suggestion and stated <br />that the task of reviewing the comp plan should be done with an attitude of <br />anticipating the future rather than reacting to the current. <br /> February 4, 1986 <br /> <br />Page 6 of 7 <br /> <br /> <br />
