Voting No: None.

Commissioners Deemer and Zimmerman reported on a zoning seminar they attended
sponsored by the University of Minnesota Extension Service.

Commissioner Zimmerman stated that at the seminar it was learned that:

1. Rezoning by the city must be supported by justification.

2. ~here may be legislation requiring farmers and developers to cut
down on soils loss.

3. Utilization of Special Use Permits versus Conditional Use Permits
can be ruled by the courts as discrimination.

Chairman Peterson inquired if it would be possible to encourage legislators to
amend the law to allow for special use permits.

Ms. Norris stated that she has discussed this issue with the League of
Minnesota Cities and Mr. Lefevere; they both say that one of the conditions of
the conditional use permit can be duration, as long as it is reasonable.

Commissioner Zimmerman stated that this Commission should review the City's
Comprehensive Plan annually.

Mr. David Hartley agreed with Commissioner Zimmerman's suggestion and stated
that the task of reviewing the comp plan should be done with an attitude of
anticipating the future rather than reacting to the current.
February 4, 1986
