~he Commission reviewed the proposed conditional use permit agreement and added <br />the following item: <br /> <br />'7. Hours of operation shall be between the hours of 6:00 a.m. and <br /> 8:00 p.m. for company vehicles.' <br /> <br />Commissioner Shtm~ay stated that he doubts Mr. Knudson will be able to store <br />the 5 trucks, 2 bobcats, farm tractor, etc. in a 44' x 60' pole building. <br /> <br />Commissioner Hendriksen stated that this Co~m-,ission has to make a decision as <br />to whether or not all of these items can be stored in the pole building and if <br />not, a decision has to be made as to whether or not another on-going liability <br />will be created for the City. Commissioner Hendriksen stated that he doesn't <br />feel that the fact that there is an existing pole barn at this location should <br />enter into the decision. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Shumway to <br />recommend denial of Mr. Wayne Knudson's request for a conditional use permit to <br />operate his cement contracting business from his home at 15401 Armstrong Blvd. <br />N.W. <br /> <br />Motion failed. Voting Yes.' Commissioners Shumway, Hendriksen and Howell. <br />Voting No: Chairman Peterson, Commissioners Zimmerman, Deemer and LaDue. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner De~mer to recommend <br />approval of Mr. Wayne Knudson's request for a conditional use permit to operate <br />his cement contracting business from his home at 15401 Armstrong Blvd. N.W. <br />contingent upon Mr. Knudson entering into a conditional use permit agreement <br />with the City. <br /> <br />Further Discussion: Commissioner Deemer noted that Mr. Knudson has been above <br />board regarding his intended use of the pole building and is attempting to <br />operate legally, unlike many other situations in Ramsey. Commissioner LaDue <br />stated that Mr. Knudson's application should be taken in good faith and <br />judgement should not be made based on past problems in the neighborhood. <br />Commissioner Shtm~way questioned how the Commission can consider recommending <br />approval when no public spoke out in favor of the request. Chairman Peterson <br />stated he thinks the public was under the assumption that a 'cement <br />contracting' would be comparable to a cement ready-mix business. Commissioner <br />LaDue stated that he doesn't see any of Mr. Knudson's operation being <br />detrimental to neighboring property owners. Ms. Norris stated that with <br />respect to sufficient space being provided for storage of equipment with the <br />existing pole building, Mr. Knudson can add on additional accessory structure <br />space up to the maximtln limits, but that additional space cannot be used for <br />company vehicles. Commissioner LaDue noted that the fact the accessory <br />structure already exists did not enter into his decision to make this motion. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Zimmerman, <br />Deemer and LaDue.
