easement. Mr. Otto also noted that there is a certain amount of debris that has been deposited on <br />the subject property and the development agreement should require the clean-up of that debris. The <br />development agreement would also have to be modified to reflect all fee title owners involved. <br /> <br />Ron Ylitalo, Attorney for Ray Wojcik, one of the fee title owners, was present. Ron Ylitalo <br />explained that the developer was concerned with providing a 66' easement to access the outlot <br />because said access would have to cross a swampy area and it would be more reasonable to access <br />the outlot from the north. The developer is also concerned with providing an easement for the <br />future extension of Chameleon Street N.W. through Lot 1 to access the property north of Lot 1 and <br />the impact of said easement on Lot 1. <br /> <br />Mayor Reimann explained that in the interest of future planning, it is the City's policy to not allow <br />subdivisions to landlock any parcels. <br /> <br />Mr. Otto noted that staff's recommendation for final plat approval varies from that of the Planning <br />and Zoning Commission. The Planning and Zoning Commission recommended final plat approval <br />contingent upon receiving park dedication for the gross area being subdivided. Mr. Otto explained <br />that under the City's park dedication ordinance minor subdivisions are limited to park dedication on <br />the lots being created and not the outlots. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to adopt Resolution <br />#90-08-260 granting final plat approval to Armstrong Addition per the City Engineer's Review <br />dated May 29 and June 26, 1990 and the Park's Review dated May 29, 1990 with subsequent <br />determination of final trail alignment to occur in the fall of 1990. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, Pearson, Cich and <br />DeLuca. Voting No: None. <br /> <br />Case #8: Request of Waste Management of Minnesota for a Reduction in the <br /> Landfill Tipping Fee <br /> <br />Mr. Hartley stated that Waste Management of Minnesota, Inc. is requesting that Ramsey waive a <br />portion of the tipping fee that is charged for every cubic yard of solid waste deposited at the <br />landfill. <br /> <br />Mr. Don Otter of Waste Management was present requesting the City's assistance in allowing his <br />firm to maintain competitiveness in the market by equalizing taxes. Mr. Otter stated that he is <br />agreeable to a timeframe being applied to the request, such as July 1, 1991, in order to accurately <br />define the impact of this tax reduction. Mr. Otter also stated that they are willing to guarantee <br />Ramsey that the rebate would not fall into place unless the site received over 100 tons of waste <br />from Hennepin County on an average daily basis over the month. Mr. Otter noted that the costs <br />associated with the continued operation of the site at the volumes currently being received will not <br />meet the criteria established by the conditional use permit for vertical expansion for completing the <br />site. Mr. Otter estimated that at the current volume rate, it is estimated the site would reach capacity <br />in another seven years. <br /> <br />Mr. Hartley stated that Ramsey is being asked to forgive taxes now being charged that will amount <br />to approximately $78,000.00 per year or more and in return, Waste Management is stating that <br />Ramsey will have a landfill that will close sooner than if they did not forgive that amount of taxes. <br />Mr. Hartley proceeded to give his opinion of how this reduction in tipping fee will impact <br />Ramsey's ultimate goal to oppose development of Site "P".
