Councilmember Peterson noted that although the Anoka Police Department administers the <br />D.A.R.E. Program, Ramsey shares in the funding of it and possibly Andover too, and suggested <br />that these other cities be represented on the program materials in addition to the City of Anoka. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Conditional Use Permit for an Auto Repair Business in <br />the R-I Rural Residential District; Case of Craig Johnson <br /> <br />Sylvia Frolik stated that Craig Johnson is requesting a conditional use permit to operate an auto <br />repair business from the garage on his property at 17600 Gibbon Street N.W. Ms. Frolik stated <br />that City Staff is recommending denial of the request for a conditional use permit based on the fact <br />that auto repair businesses are not generally compatible in an R-1 Rural Residential District. Ms. <br />Frolik also noted that the Planning and Zoning Commission is recommending approval of Mr. <br />Craig Johnson's request for a conditional use permit contingent upon the activity being limited to a <br />two-vehicle operation and that the permit would become void when Mr. Johnson sells the subject <br />property. <br /> <br />City Attorney Goodrich stated that if the applicant is agreeable, time limitations on conditional use <br />permits is acceptable but probably not enforceable. <br /> <br />Mr. Johnson noted that the proposed findings of fact indicated that two of his neighbors are <br />opposed to his request, however, he has been informed by those neighbors that they would write <br />statements requesting that their opposition be lifted. <br /> <br />Ms. Frolik stated that she has received no further letters from any of the residents in the area. <br /> <br />Motion by Councilmember Peterson and, seconded by Councilmember Cich to adopt findings of <br />fact #0277brelating to Mr. Craig Johnson s request for a conditional use permit for an auto repair <br />business at 17600 Gibbon Street N.W. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, Cich, DeLuca and <br />Pearson. Voting No: None. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Pearson to approve Mr. Craig <br />Johnson's request for a conditional use permit for an auto repair business at 17600 Gibbon Street <br />N.W. <br /> <br />Further Discussion: Mayor Reimann stated that in the past the City Council has tried to apply a <br />time limit on conditional use permits in the residential district as a way of encouraging those <br />businesses to move into commercial areas. Mayor Reimann stated that the City Council tries to <br />support the businesses in the community that are paying commercial taxes while trying to compete <br />against those businesses in residential areas. <br /> <br />Mr. Johnson stated that with a two-vehicle limit, he doesn't feel his business will be creating any <br />unfair competition to those businesses in the commercial district. <br /> <br />Mr. Ron Ross of 17540 Gibbon Street N.W. was present and stated that he has no opposition to <br />Mr. Johnson's request for a conditional use permit as long as it is limited to two-vehicles and he is <br />not allowed to conduct business at all hours. <br /> <br />The City Council added another term to the conditional use permit to limit hours of operation from <br />7:00 a.m. to 10:00 p.m. daily. <br /> <br />City Council/August 28, 1990 <br /> Page 7 of 14 <br /> <br /> <br />
