Mayor Reimann asked if a leachate system, the pumping and the cap would then qualify the landfill <br />for NSP ash. <br /> <br />Mr. Otter answered that it would have to have a bottom and top liner. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich to adopt Ordinance <br />//90-21 which is an ordinance amending Section 130.02 known as the "Solid Waste Depositing <br />Fee" Chapter of the City code. <br /> <br />Further discussion: Mr. Jim Gilbertson, Ramsey, was present and asked for an explanation of <br />what was just voted on. City Attorney Bill Goodrich restated the purpose of the ordinance. Mr. <br />Gilbertson asked if the Council knew how low the taxes were that Waste Management paid for <br />their property. He stated if they get a break in their tipping fee, then every resident should get a <br />break on their taxes also. Mr. Otter stated that the ordinance has to be considered for the and also <br />went on to state that the landfill moneys have purchased millions of dollars of fire equipment, etc/ <br />for the City. Another citizen of Ramsey who was present stated that money from the landfill <br />should be spent on the fire department, parks, street lights, etc. With the reduced tipping fee, the <br />dump would fill faster and it could be closed, but with the reduced tipping fee where will the extra <br />money come from. He also stated that he would be willing to pay a couple more dollars a month <br />for taxes to pay for these things and there wouldn't be a need for the landfill money. Mr. <br />Gilbertson stated that if Waste Management didn't like the fees they were paying, no one was <br />holding a gun to their head to make them stay. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, Cich and Pearson. <br />Voting No: Councilmember DeLuca. <br /> <br />Case #8: Adult Use Zoning <br /> <br />Mr. Hartley introduced Mr. David Licht of Northwest Associated Consultants who was present to <br />explain the adult use report and recommendations he compiled that the Council had received prior <br />to the meeting. <br /> <br />Mr. Licht stated that this report should be considered preliminary and that there would be more <br />information forthcoming. He stated the report is divided into sections marked by different colored <br />pages. The white section contains an introduction summary of studies previously conducted state- <br />wide and nationwide. <br /> <br />He discussed the guidelines regarding adult uses protected by the Constitution. It is very critical <br />that these guidelines are met, however, the City can regulate secondary impact. He stated the <br />primary thrust of activity falls in two areas. The first area is zoning. The proposed ordinance <br />changes are in the green pages where there are definitions of what constitutes adult use. The <br />general provisions in the zoning ordinance pertains to all adult uses. Principal activity use is an <br />entire store or theater and accessory use is a movie rental establishment that has adult rated movies <br />along with other rated movies and convenience stores what have adult magazines. Adult uses <br />cannot be in a building combined with residential uses. The building containing the adult material <br />must be 750' (approximately two blocks) away from residences, daycare facilities, public facilities, <br />on-sale liquor establishments and another adult use building. The signing for an adult use <br />establishment must be generic. Adult use accessories such as convenient stores, movie rental <br />places, etc. cannot use more than 10% of the floor area for the adult material and that particular area <br />needs to be prohibited from minors. He stated that the City's zoning needs to be reviewed and be <br />more detailed. There are three types of uses. They are described as follows: 1) Permitted Use <br />can automatically exist; 2) Accessory Use is a compliment to a permitted use; and 3) CUP is an <br />allowed use provided certain criteria is followed.
