Mr. Hartley replied that every realm of enforcement investigation available is being used. Mr.
Hartley then noted that the Planning and Zoning Commission will again be reviewing the proposed
zoning changes with respect to adult uses on Monday, October 22, 1990.

Councilmember DeLuca stated that the proposed zoning amendment establishes what is considered
to be a reasonable area of opportunity for adult uses. He then inquired as to what the ramifications
would be if that opportunity area decreases as the City develops.

Mr. Hartley replied that the City has provided the opportunity and it is simply a case of the
opportunity being used up.

Councilmember DeLuca inquired as to what the ramifications would be in a scenario where the
City approved a zoning change to implement a residential district that reduced the property available
for adult uses.

Mr. Hartley replied that, if, in the future, things change so that the opportunity for adult uses has
lessened, then as long as the unit of government did not have a hand in changing that clearly for the
purpose of eliminating that use, he believes the ordinance will stand.

ADJOURNMENT

Motion by Councilmember DeLuca and seconded by Councilmember Peterson to adjourn the City
Council meeting.

Motion carded. Voting Yes: Mayor Reimann, Councilmembers Pearson, Peterson and DeLuca.
Voting No: None. Absent: Cich.

The City Council meeting adjourned at 9:55 p.m.
Respectfully submitted,

Sylvia Frolik
Planning Assistant

David Hartley
City Administrator

Public Hearing/October 9, 1990
