Mr. Otto noted that in a scenario of odor problems occurring on a holiday weekend, the residents <br />would be subjected to nuisance odors for a period of four days if they were only required to <br />address the problem within two working days. <br /> <br />Mr. Hartley suggested that Item #24 of the proposed Conditional Use Permit regarding remedy of <br />odors be amended to indicate that action will be taken upon a substantiated complaint versus a <br />substantial complaint. <br /> <br />Mr. Miller indicated that Waste Management is agreeable to amending Item #24 to indicate <br />substantiated complaints and requiring remedy of odor problems within 48 hours. <br /> <br />Mr. Otto suggested and City Council agreed that Item #40 be added to the proposed Conditional <br />Use Permit to indicate that Ramsey residents will be allowed to dispose of yard waste material at <br />the facility on a private basis at no charge. Ramsey residents will also be able to receive finished <br />compost material for non-commercial purposes at no charge. Further, that these services will be <br />offered to Ramsey residents on Saturday mornings only. <br /> <br />Mr. Goodrich advised and City Council agreed that Item #39 of the proposed Conditional Use <br />Permit be amended to read as follows: <br /> <br />"Upon request of the City, the performance of this operation shall be reviewed by <br />Waste Management of Minnesota, Inc. and the City Administrator or his <br />representatives, to identify problem areas and concerns and to evaluate whether <br />conditions of this CUP need to be modified or procedural changes made. A <br />performance review shall occur no later than September 30 of each year. <br /> <br />Motion by Mayor Reimann and seconded by Councilmember Pearson that on the basis of <br />the foregoing findings, the City Council concludes that the proposed use complies with the <br />requirements of the City Code Section 170.013D and accordingly approves the application <br />for a Conditional Use Permit by Waste Management of Minnesota, Inc. for a yard waste <br />compost facility and grants the Conditional Use Permit as reviewed and amended on <br />October 23, 1990. <br /> <br />Further Discussion: Mr. Douglas Fountain recalled a prior proposal for an incineration <br />business in Ramsey where City Council denied access to the company upon the advice and <br />input of Ramsey citizens concerned with air pollution and contamination. Mr. Fountain <br />requests that before City Council makes their decision regarding Waste Management's yard <br />waste proposal that they remember that the citizens of Ramsey are entitled to clean water <br />and clean air. Mr. Fountain stated that City Council should also take into consideration <br />other yard waste compost facilities that have closed because of odor problems. Mr. <br />Fountain asked City Council to make a decision, keeping in mind that government is of the <br />people, by the people and for the people. <br /> <br />Motion carried.
