Mayor Reimann noted that the applicants are requesting that the term on the Conditional Use Permit <br />be four and one-half years and he was of the understanding that it would be for a one-year trial <br />basis. <br /> <br />Mr. Steve Kollodge indicated that Waste Management is requesting a term of four and one-half <br />years but is agreeable to annual performance reviews. If there is a major problem, the City has the <br />option to revoke the Conditional Use Permit. Mr. Kollodge noted that if the City is insistent, <br />Waste Management is agreeable to a one-year term but would prefer to have language incorporated <br />in the Conditional Use Permit that would allow for an automatic extension without going through <br />the entire Conditional Use Permit application process each successive year thereafter. <br /> <br />City Attorney Goodrich noted that if the Conditional Use Permit were to expire after one year, a <br />new application and public hearing process would be required to extend the facility. <br /> <br />Councilmember DeLuca expressed concern that a full cycle of composting may take longer than <br />one year and that when the Conditional Use Permit application would come up for renewal, the <br />City would not have all the information it needs to make a decision. <br /> <br />Mr. Otto confirmed that according to the Rutger's Method, a complete composting cycle could take <br />16-18 months. <br /> <br />Mr. Lyle Hanson--6905-151st Avenue N.W.--stated that he does not believe the residents want <br />this composting facility at all because they are already putting up with odors from the landfill. Mr. <br />Hanson stated that he is also concerned with the idea of accepting grass clippings at the compost <br />facility when there is no way to know the amount of herbicides that have been applied to that grass <br />material. Mr. Hanson inquired as to the benefits of this compost facility to Ramsey residents. <br /> <br />Mr. Terry Miller replied that disposal of yard waste to Ramsey residents will be free and compost <br />material will also be available to Ramsey residents at no charge. The only stipulation is that this <br />service will be offered to Ramsey residents on Saturdays only. <br /> <br />Mr. Hanson inquired as to what the consequences will be if the site is determined to be a public <br />nuisance prior to the Conditional Use Permit expiring. <br /> <br />Mr. Otto replied that under the terms of the Conditional Use Permit, Waste Management would be <br />obligated to address the problem. If it is a consistent problem, the odor causing material would <br />have to be land spread. The final option is to initiate proceedings to revoke the Conditional Use <br />Permit. <br /> <br />The City Council amended Item #1 of the proposed Conditional Use Permit to indicate a term of <br />twenty months from the date of issuance. <br /> <br />Mr. Morsefelder, attorney for Waste Management, requested that language be added to the <br />Conditional Use Permit to indicate that the applicant has the option to re-apply for a Conditional <br />Use Permit for the yard waste facility for an additional period of time. <br /> <br />Mr. Goodrich indicated that he would add such language to the permit. Mr. Otto stated that Waste <br />Management is requesting to replace "48 hours" with "two working days" in that term which <br />requires remedy of odor problems. <br /> <br />City Council/October 23, 1990 <br /> Page 16 of 18 <br /> <br /> <br />
