Case # 2: Consider Agreement for Relocation of Home on $chleper <br /> Parcel Regarding 153rd Avenue N.W. Right-of-Way <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Pearson to authorize the Mayor, <br />upon recommendation of the City Attorney and the City Engineer, to execute a Land Acquisition <br />Agreement between the City of Ramsey and Mrs. Schleper and authorize the City Engineer to <br />contract on behalf of the City with various vendors to accomplish relocation of the Schleper home <br />on the subject property. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Pearson, Peterson, Cich and <br />DeLuca. Voting No: None. <br /> <br />Case # 3: <br /> <br />Di$¢u88 Planning and Zoning Commission Report Regarding <br />an Ordinance Amending Chapter 9 of the City Code <br />Regarding Adult Uses <br /> <br />Mr. Hartley stated that, at this point, he is requesting input from City Council regarding some of <br />the sections in the Ordinance amending Chapter 9 of the City Code regarding adult uses. <br /> <br />The first item is churches. Although the Supreme Court decisions indicate that communities can <br />place a distance requirement upon adult uses from churches, Ramsey's ordinance has not included <br />churches as one of the protected uses. The reason churches are not listed as a protected use is to <br />avoid having a content-based ordinance versus a content-neutral ordinance. In addition to that, <br />some churches feel they need to establish missions that are located near adult uses. On the other <br />hand, young people attend churches and it is the secondary effect of adult uses that affect young <br />people. <br /> <br />The consensus of the City Council was that churches should be listed as a protected use, but they <br />should not be prohibited from locating near adult uses if they so desire. <br /> <br />Mr. Hartley stated that the next issue to be discussed is the fact that the Planning and Zoning <br />Commission has recommended that the area to be zoned "Business Warehouse" east of Sunfish <br />Lake Boulevard be moved to that area between Armstrong Boulevard and Ramsey Boulevard. In <br />addition, that area that falls into the County Park area should be deleted as eligible for adult uses <br />and replaced also in that area between Armstrong Boulevard and Ramsey Boulevard. Mr. Hartley <br />explained that the Planning and Zoning Commission is of the opinion that the area east of Sunfish <br />Lake Boulevard is prime industrial property and should not be allocated for adult uses. In <br />addition, Mr. Hartley stated that the Planning and Zoning Commission is recommending that the <br />distance requirement for adult uses from protected uses should be increased from 750' to 1000'. <br /> <br />Mr. Goodrich indicated that a more important issue than the distance requirement is the overall area <br />that is being provided for adult use opportunities. The Supreme Court decisions indicate that 5% <br />of the overall community being available for adult uses is acceptable. If the City were to revise its <br />ordinance amendment to increase the distance requirement from 750' to 1000', the amount of space <br />available in the City overall for adult uses would decrease to 1.2%. Mr. Goodrich stated that he <br />feels that the City should remain with the 750' distance requirement as proposed. <br /> <br />Councilmember DeLuca dismissed himself from the meeting at 6:32 p.m. Upon leaving, <br />Councilmember DeLuca did note that he does not believe that the proposed Business Warehouse <br />District is appropriately located adjacent to Highway 10. <br /> <br />City Council/November 8, 1990 <br /> Page 2 of 3 <br /> <br /> <br />
